Special Council Meeting <br />1/2/95 <br />Page Nine <br />the 10 with the understanding that annually coincidental with the report (it is kind of <br />like a renewable lease)--it is a lease with 14 year options on it. But, we are basically <br />saying, the life of this is 15 years; annually there will be a report. Council will have an <br />opportunity for comment. We will approach it based on objective standings. Let's <br />assume that we get that language down momentarily. But,15 years--annually open to <br />review. The presumption is it will be renewed unless somebody comes in and says put <br />the kabosh to it. That way, that is each of the points that I am hearing tonight. <br />Mr. Ferrante asked how much time they will have to review it. <br />Mayor Rinker said Council needs to write that in. The fact of the matter is, that's up to <br />you. <br />Mr. Ferrante said we have to have a report at a certain time of the year so that we have <br />time to review it. <br />Mayor Rinker said he has two suggestions: one is that we hash that out tonight. Two, <br />we treat this as enabling legislation which sets the spirit and in gross terms the <br />framework of this. Then, like putting siding on a house, you come back and you have a <br />second ordinance that would tie into it that deals with the specifics. This is enabling <br />legislation that makes the commitment, but then you have one that says here's what the <br />criteria should be. He thinks you want to keep it pretty general, but still enough. We <br />know when we are going to pay it out. When should we expect the report? What type <br />of information should be provided, realistically, in the report the school gives back and <br />within a reasonable period of time; I would say at least a 30-day period which goes for a <br />full cycle of Council then Council can always just say look, we are going to hold up on <br />this--we are going to look at this for a few more weeks. At least you have an <br />opportunity to say we want to intervene, otherwise the presumption is it will <br />automatically kick over into the next year--every year for the next 15 years. <br />Mr. Fixler said as Mr. Flynn stated before which -I thought was a good idea, the report <br />that we are going to receive from the school-let's give it to the residents. Let them see <br />exactly where the dollars are going. I think it is the right thing to do. Then, the <br />residents see exactly where this money is going. Whether they are for or against it, they <br />will understand it better. I think that is an excellent suggestion and think it should be <br />written in the ordinance. <br />Mayor Rinker said the whole idea is that we keep working on this thing and have this <br />type of discussion. We have almost an endless opportunity to be able to articulate it and <br />get the word out. So, I agree. I support all those things. I just want a chance to be able <br />_ to do it and do it right.
