Regular Council Meeting <br />1/16/95 <br />Page Thirteen <br />for Beech Hill culverting work. <br />ROLL CALL: AYES: All <br />NAYS: None <br />Motion Carried <br />Expenditure Approved <br />Upper 40 - Update - Mr. Cappello said in December, per the Army Corps of Engineers <br />request, we temporarily withdrew the application for a permit to install the detention basin <br />in the Upper 40 area. EDP Consultants performed a small study to see the feasibility and to <br />give the Council the cost estimates on how to proceed with the conceptual mitigation. In <br />the near future, we should look those over and decide how we want to progress. <br />Council President Fixler asked Mr. Cappello to explain conceptual mitigation for the <br />audience. <br />Mr. Cappello said it gives the Army Corps of Engineers ideas on how they can replace a <br />site which would be destroyed or modified during construction. This could be like a <br />prototype because the Corps has not seen something like this before. <br />Mr. Fixler asked the time frame that he thinks Council needs to get involved and act on <br />this. <br />Mr. Cappello said in the next few months. <br />Mr. Flynn asked if there is any way we could have anticipated this spin that was thrown on <br />us by the Army Corps of Engineers or the Feds or whoever stopped this project after we <br />had expended a good sum of funds. <br />Mr. Hovancsek said the basic reason why there was a problem with the review was <br />because of public opinion that was concentrated on the government level (at the Corps of <br />Engineers level in Buffalo, New York; at the State Representative level in Columbus, Ohio; <br />at the Ohio Department of Natural Resource level as well. T'here were a lot of concerns <br />about this project and that threw out a bunch of caution flags which slowed the project <br />down. It slowed the project down to a point that we were not eligible to accept the <br />DOPWIC grant that we had. Had that not occurred, this project would have been under <br />construction. <br />Mr. Flynn asked how we could avoid any pitfalls in our second thrust. <br />Mr. Hovancsek said all the various agencies have already been contacted about this project. <br />At this point in time, it will be up to us (with the help of the Metropark Board--they are
