<br />Regular Council Meeting <br />March 20, 1995 <br />Page Nine <br />Mayor Rinker said we received an itemized billing statement from the attorneys. It is a <br />pretty thorough statement. This is under our old deductible from our former policy. <br />We tried very hard to deal with this short of litigation; we had no choice when we were <br />brought into it. We succeeded in a very short time to be dismissed from the case and <br />yet we are still looking at $7,000 plus. It is sobering to know when people want to <br />litigate the kind of expense they can cause to their own taxpayers. That is unfortunate <br />and one of the reasons we try to keep a high deductible to cut premiums. <br />Roll Call: AYES: All <br />NAYS: None Motion Carried <br />Expenditure Authorized <br />Ball Diamond Drainage - A motion authorizing the ex?enditure of not more than <br />5 000 - Mr. Fixler said before we have the motion, he would like Mr. Buckholtz to <br />please explain the situation with the drainage on that field. <br />Mr. Buckholtz said Recreation began in the Fall to collect bids. They ran into some <br />difficulty. We have three bids--two were refusals to do the job. We have a two-part <br />plan from Countryview Landscaping. We are just talking about doing the first half of <br />it. He has been out on the fields playing ball and knows the fields real well. Mr. <br />Buckholtz said we want to talk to him about what kind of a guarantee he will give to <br />this project. He asked if Mr. Dragman was in the audience. <br />Mr. Dragman was in the audience. Mr. Fixler asked him what type of guarantee he will <br />offer. <br />Mr. Dragman said the problein will be maintenance afterward. After he does the field, <br />he will guarantee there will be no standing water on the playing field and that the field <br />will drain in a reasonable amount of time after a heavy rain. As long as there is good <br />maintenance done to the field it could last for quite a while. He asked if they were <br />asking him to put a time frame on it. <br />Mr. Fixler said if you were at least going to say that through that first season if we get <br />substantial downpours and the system does not work, you are going to come out and <br />repair it free of charge--number one. Number two: the maintenance procedures that <br />you are referring to now--would you train our groundskeeper for instance to explain <br />exactly how this system should be maintained so therefore, in the future we won't have <br />these problems. <br />Mr. Dragman said yes, that would be acceptable. He definitely would guarantee his <br />work through the whole playing season if he is able to train the groundskeeper or <br />explain to him what to do with the field for maintenance--he would absolutely go one <br />year.
