<br /> <br /> <br />Regular Council Meeting <br />5/15/95 <br />Page Three <br />Mayor Rinker asked for a definition of the word "mandate." He thinks it is clear <br />that this is a project that must go forward or the kinds of dollars that have been <br />committed would not have been committed. <br />Mr. Januska said he is not sure he can explain what a mandate is; your Law Director <br />probably can. He said that a Federal law is a manda.te. What our agency does is to <br />enforce Federal laws. One of the Federal laws we want to have control of is the law <br />that requires us and other entities to clean up pollution. We have identified certain <br />areas in this community and other communities associated with this particular <br />project. Those are all required by laws that say you have to clean up your pollution. <br />We had directed them to build this particular project and other projects tied into the <br />Hilltop Interceptor Sewer Project. In effect, this is a part of a major project that has <br />been mandated by a Federal law. Mr. Januska said he would submit that this has <br />been mandated because it is a part of the whole. <br />Mayor Rinker asked about the litigation brought against the City of Cleveland. <br />Mr. Januska said as a result of that litigation, major projects necessary in the <br />metropolitan area of Cleveland were identified. , <br />Mayor Rinker asked if there were funds that were dedicated before, why not now? <br />Mr. Januska said the Federal government is essentially having to deal with this <br />project. Federal funds have been cut back for sewer construction projects. <br />Essentially, there isn't any more funds. That is why the State of Ohio began the <br />programs such as Issue II to help fund various sewer projects for communities after <br />Federal funds have been dried up. <br />Discussion was held. <br />Mayor Rinker said he is of the understanding that the commitment was made years <br />ago. It has taken time for these projects to be carried out. There is no doubt this will <br />be going.forward. <br />Mr. Januska said that is correct. <br />Mr. Monaco (in the audience) said he understands that there is a Bill in Congress <br />right now that will release billions of dollars for water and sewer projects. If this bill <br />passes, he asked if the money will come our way for the North County Line Trunk. <br />He said that is for mandated, so if we are not mandated, we need to be mandated.
