Regular Council Meeting 5/15/95 Page Four Mr. Januska said if you are asking if this project is mandated, it is covered under Federal law. Mr. Januska said there is a law that says you must clean up pollution; there is no law that says you must sewer. Mr. Monaco said they had heard that to be mandated the area has to be declared a health hazard. He asked if we have been declared a health hazard. Mr. Novickis said he does not believe that is the case. There is not one that can ever declare an area a health hazard (except possibly in the middle of a landfill.) If there is a need for sewers in that area, it is a mandate. You are breaking Federal law. There is a need for sewers and its is justified. Mr. Monaco asked what can be done for them to get more funding. If the wording of the project will bring them funding, that is what they are looking for. Mr. Januska said there are certain state laws. Mr. Monaco said they are looking for solutions, not to stop things or even to necessarily slow them down. Mr. Januska said he is not the person to answer questions regarding Federal funding. Mayor Rinker said that is the primary reason for the resolution. We will forward this to Mr. Fixler said we want to make sure that 2-3 years from now if some monies become available, we want to make sure we qualify for those dollars. Mr. Christian, (in the audience) said when the Federal government passes that Clean Water Act this year, if they do, and monies do become available for mandated projects, this project won't get any of that money unless it is becomes mandated. He asked if there is a way to have this project mandated--written down on paper that this project is mandated? Mr. Fixler said that in speaking with Congressman LaTourette's office the funds just aren't available; they don't have enough funds to go around. He is not sure they can answer that for you tonight. Mayor Rinker said this project is mandated.
