Regular Council Meeting <br />5/15/95 <br />Page Four <br />Mr. Januska said if you are asking if this project is mandated, it is covered under <br />Federal law. Mr. Januska said there is a law that says you must clean up pollution; <br />there is no law that says you must sewer. <br />Mr. Monaco said they had heard that to be mandated the area has to be declared a <br />health hazard. He asked if we have been declared a health hazard. <br />Mr. Novickis said he does not believe that is the case. There is not one that can ever <br />declare an area a health hazard (except possibly in the middle of a landfill.) If there <br />is a need for sewers in that area, it is a mandate. You are breaking Federal law. <br />There is a need for sewers and its is justified. <br />Mr. Monaco asked what can be done for them to get more funding. If the wording of <br />the project will bring them funding, that is what they are looking for. <br />Mr. Januska said there are certain state laws. <br />Mr. Monaco said they are looking for solutions, not to stop things or even to <br />necessarily slow them down. <br />Mr. Januska said he is not the person to answer questions regarding Federal <br />funding. <br />Mayor Rinker said that is the primary reason for the resolution. We will forward <br />this to <br />Mr. Fixler said we want to make sure that 2-3 years from now if some monies <br />become available, we want to make sure we qualify for those dollars. <br />Mr. Christian, (in the audience) said when the Federal government passes that <br />Clean Water Act this year, if they do, and monies do become available for mandated <br />projects, this project won't get any of that money unless it is becomes mandated. He <br />asked if there is a way to have this project mandated--written down on paper that <br />this project is mandated? <br />Mr. Fixler said that in speaking with Congressman LaTourette's office the funds just <br />aren't available; they don't have enough funds to go around. He is not sure they <br />can answer that for you tonight. <br />Mayor Rinker said this project is mandated.
