He <br />thinks the Village made Progressive make a bridge across the river that had to take a <br />100-year flood. We have culverts in the Worton Park area that can't take three or <br />four at a time like we had last week. He wishes to bring to the attention of Council <br />that this should be made an emergency issue for two reasons: 1) one area of North <br />Woodlane Drive is undercutting the road and as a result of the storms we have had <br />this past couple of weeks the Village lost the horizontal width of 2', so we are losing <br />soil and losing property every time we have a storm. He is a geologist and knows <br />pretty well what is going on erosion-wise. There are two creeks on his property. <br />The downspout that goes out into the creek--two years after he moved here, it stuck <br />out so far he had to cut it off and he cut off about 2'. Now, he is getting to the point <br />where he has to cut if off again. The stream is no longer undercut. It is riding on <br />the shale. Now, the stream is getting wider. As a result, it is starting to encroach on <br />the south side of North Woodlane Drive and is already undercutting on the north <br />side. This is an emergency issue. There are several people that are involved. It is <br />something Council needs to do as an emergency issue. <br /> <br />Larry Pollak, 6726 Wilson Mills Road said this is in regard to the rezoning of the two <br />residential properties to commercial. It was his understanding when he originally <br />built his property (he came to the Mayor and City Council at the time) that they were <br />not going to allow any commercial zoning past where it presently was. He thinks it <br />negatively impacts the home owners in that area. He has not seen any of the <br />drawings of Deacon's and thinks it is premature--but he happened to hear about that <br />and thinks that other residents are distressed about it. The residents were not told <br />what was going on. <br />Council President Fixler said Mr. Deacon has provided us with a model. It is not <br />Council's power to change any zoning whatsoever, whether we are in favor or not <br />in favor, of any change in any zoning. It would have to go to a vote of people one <br />way or the other. It is not going to be the Mayor or the Council deciding one way or <br />the other--it will be our constituents. They will ultimately decide. We will make <br />available any plans and as the situation progresses, we will certainly try to keep you <br />informed. Anytime you want some updated information, please come forward. <br />Mr. Pollak asked if Deacon's makes a proposal that the residents at least be <br />informed. He realizes it is not going forward as fast as somebody told him, so he <br />may be a little premature. <br />Mayor Rinker said by Charter, any change like this has to be put to a referendum <br />vote to begin with.
