336
Special.Council Meeting 8/28/95
Page 12 ,
Mr. Hanculak said there should be no problem.
Mr. Brett said the Law Department has negotiated a much better contract for the
Village. They have agreed to $500/month (from $125) with a 5% increase (as opposed to
a 3%).
First Reading of Ordinance No. 95-69, entitled; "An emergency ordinance authorizing
an agreement with Power Fone, Inc. relative to a communications tower." Introduced
by Mayor Rinker and Council as a Whole.
Mr. Ferrante, seconded by Mr. Busa, made a motion to suspend the rules of Council
requiring an ordinance to be read on three separate occasions.
Roll Call: AYES: All
NAYS: None Motion Carried
, Rules Suspended
Mr. Ferrante, seconded by Mrs. Cinco, made a motion to enact Ordinance No. 95-69.
Council President Fixler asked if the legislation should read Power Fone or Nextel.
Chief Mohr said Power Fone is the parent company (for Nextel), so Power Fone is
correct.
Mayor Rinker said there are changes to be made to the contract, but not as to the major
terms. Council's passage of ?the legislation is contingent upon a final approval between
the Mayor, the Law Director, Chief Mohr and Nextel's Law Department.
Mr. Hanculak said Mayor Rinker (as Mayor) would be authorized to execute that
contract, so obviously it is contingent upon that execution.
Roll Call: AYES: All
NAYS: None Motion Carried
Ordinance Enacted
First Reading of Ordinance No. 95-70, entitled; "An emergency ordinance amending the
appropriation ordinance No. 95-20." Introduced by Mayor Rinker and Council as a
Whole.
Mr. Ferrante, seconded by Mr. Basile, made a motion to suspend the rules of Council
requiring an ordinance to be' read on three separate occasions.
