370
Regular:. Council Meeting, ,
10/16%9'5 ?
Page 6
Mayor Rinker said in any contract, if they do not honor the contract, we are entitled
to go to an alternate source. _
Cracksealing Work - Hickory Hill/Zorn - Mr. Hovancsek said he got two informal
prices: $3,500 and $6,000 for that work (it was not included in the work done on the
sewer project.)
Council President Fixler said the ruts of their larger trailers took strips out of the
cracks. He saw it with his own eyes. He believes they were damaged because of the
work done by the contractor in the area. The cracksealing was intact before they
started; there is no reason why the cracksealing would have deteriorated to this
degree. He feels they are responsible for it.
Mr. Hovancsek said he will look at the area.
Mayor Rinker said if we have eyewitnesses, we should submit a statement regarding
the condition before and after to the County to see if they will honor the contract.
Councilman Busa and Council President Fixler said they saw it firsthand.
Mayor Rinker asked Mr. Hovancsek to contact the County tomorrow about what the
Council representatives are saying--that they observed this directly and see what the
response will be. He said we could authorize, now, pending reimbursement from
the County to negotiate it on the lower of the two bids so that we remediate the
problem and present it to the County.
Mr. Hovancsek said the prices were $3,500 from Cross Roads and $6,000 from
Pavement Technology. He suggested we first talk to the contractor about their
contractor doing it as opposed to us doing it and seeking reimbursement.
Mayor Rinker they have done an excellent job in the work done there; their
response time has been good. He said we can impress upon them the need to do
this quickly.

Mr. Busa, seconded by Mr. Basile, made a motion to authorize an expenditure not
to exceed $3,500 for cracksealing work at Hickory Hill/Zorn (if necessary.)
Roll Call: AYES: All
NAYS: None
Motion Carried
Expenditure Authorized
