U J <br />37 <br /> <br />Mr. Busa asked if there were any comments. <br />There were none. <br />Roll Call: AYES: Al1 <br />NAYS: None Motion Carried <br />Rules Suspended <br /> <br />Mrs. Bloom, seconded by Mr. Spellman, made a motion to pass Ordinance 83-5. <br />Mr. Busa asked if there was any discussion. <br />There was none. <br />Roll Call: AYES: All <br />NAYS: None <br />Motion Carried <br />Ordinance Passed <br />Ordinance 83-6, entitled; "AN ORDINANCE AMENDING SECTION 303.99, 333.01, <br />333.02, AND 335.07 OF THE CODIFIED ORDINANCES OF MAYFIELD VILLAGE, REPEALING <br />ALL ORDINANCES INCONSISTENT THEREWITH.AND DECLARING AN EMERGENCY." Introduced <br />by Mayor Beebe and Council as a Whole. <br />Mr. Carmen, seconded by Mrs. Sloom, made a motion to suspend the rules of <br />Council requiring an ordinance to be read on three separate occasions. <br />Mr. Busa asked if there were any comments. <br />Mro Feneli explained this ordinance was to amend our traff ic code. He <br />suggested Council consider the new provision of the State Code that mandates <br />a three day prison term for the first offense of driving under the influence <br />of alcohol. He said this could be labeled as a first degree misdemeanor and <br />leave the sentence decision to Judge Grogan. <br />Mr. Carmen asked how many DWI's Mayf ield Village usually issues. <br />Sgt. Jack Jay (who was in the audience) reported there were 100 cases last <br />year,which was a low figure. <br />Chief Stevens said he deferred comment because he felt the former State law <br />was not harsh enough but he realizes he will be in violation of the jail <br />standards. <br />Mr. Carmen and Mrs. Bloom withdrew their motions to suspend. They recommended <br />this ordinance be discussed at the next Council Caucus. <br />Council agreed to discuss it in Committee.
