51 <br /> <br /> <br />OLD BUSINESS <br />Ordinance 83-6, entitled; "AN ORDINANCE AMENDING SECTION 303.99, 333.01, <br />AND 335.07 OF THE CODIFIED ORDINANCES OF MAYFIELD VILLAGE, ENACTING SECTIONS <br />333.09 AND 333.10 OF THE CODIFIED ORDINANCES OF MAYFIELD VILLAGE, REPEALING <br />ALL ORDINANCES INCONSISTENT THEREWITH AND DECLARING AN EMERGENCY." Introduced <br />by Mayor Beebe and Council as a Whole. <br />Mr. Feneli said Council received an amended version of this ordinance which <br />removes from the penalty section under Driving Under the Influence all <br />paragraphs relating to mandatory sentencing. The penalty would be classif ied <br />as a f irst degree misdemeanor which is the maximum penalty allowed. <br />Mr. Busa said this ordinance was given f irst reading on February 21. It has <br />been amended to leave the jail sentencing to the Judge's discretion. He cited <br />the need for passage of this ordinance. <br />Mr. Carmen, seconded by Mrs. Hanus, made a motion to suspend the rules of <br />Council requiring an ordinance to be read on three-separate occasions. <br />Mr. Busa asked if there was any discussion. <br />There was none. <br />Roll Call: AYES: All <br />NAYS: None <br />Motion Carried <br />Rules Suspended <br />Mr. Carmen, seconded by Mrs. Bloom, made a motion.to pass Ordinance 83-6, <br />as,amended. <br />Mr. Busa asked if there was any discussion. <br />There was none. <br />Roll Call: AYES: All <br />NAYS:. None <br />Motion Carried <br />Ordinance Passed <br />Metro Park Violations <br />Mr. Busa said he understands there are some violations as far as construction <br />is concerned and that they plan to remove some houses on SOM Center Road. <br />Mr. Carmen said he placed a phone call regarding this but has not yet received <br />a return call. <br />Mr. Amendola reported 28 out of 38 homes owned by the Park will be knocked <br />down, two of which are in the Village.
