20 <br />Mrs. Mikula.stated that.under the umbrella of an American citizens rights <br />granted under_the Constitution of this Democratic Republic, she wishes to <br />have the right to view and study official public records regarding financial <br />and legislative matters of Mayf ield Village..She questioned, does the <br />federal freedom of information law apply.to residents of this community as <br />well as articTes of the State of Ohio Revised Code, the Sunshine Law and <br />our municipal Charter? She stated she felt she had to forfeit areas of her <br />civil rights at the insistence of Mr. Gus Amendola who stated the "laws" and <br />conditions he had given were to be from the Mayfield Village Law Director. <br />Mrs.. Mikula stated that consequen.tly, Mrs. Ruggles demanded a written list <br />of questions that were then to be typed by the Village Hall Secretary and <br />she was told she would have to sign said copy before she would receive any <br />information. She stated the Village Secretary was preoccupied with packets <br />and would be unable to type the needed paper until much later. She said Mr. <br />Amendola told her the Financial Advisor is a Clerical worker and emphasized <br />she, Mrs. Maynard and Mrs. Minor would have to follow his orders while the <br />Mayor is away. Mrs. Mikula said nothing like this was imposed under any <br />other administration, that she was able to research for several hours at a <br />time with no questions asked. <br />Mrs. Mikula stated there were only five items on the list of questions she <br />submitted. She stated she had waited for over three weeks until the time <br />was convenient for Mrs. Ruggles to answer her questions. Mrs. Mikula.asked <br />if Mr. Amendola and/or Mr. Feneli would identify the State statute and <br />municipal laws which formed their opinions that deprived her of the information <br />she is entitled to. Mrs. Mikula stated it is unfortunate Mrs. Ruggles is <br />not present at this meeting. She stated she has obtained financial information <br />from other communities without even being asked her name. <br />Mrs. Mikula said she would like to know what is considered a state of emergency <br />and who in Mayfield Village has the authority to declare an emergency according <br />to our own legal laws. She said she believes, according to the Charter, that <br />when the Mayor is not here the President of Council is in charge, should the <br />President of Council not be here then the President Pro Tem would be in charge <br />of the Village. She mentioned an ordinance which was passed some years ago <br />which includes the job description of the Administrative Assistant but does <br />not mention the President Pro Tem, therefore conflicting with the Charter. <br />Council President Spellman stated in his opinion the Charter overrides any <br />ordinance. <br />Councilman Carmen verified this is correct. <br />Council President Spellman read Section 7, Article 4 of the Charter which <br />states the President Pro Tem shall become the Acting Mayor when the Mayor and <br />President of Council are both absent from the municipality. Therefore, Mrs. <br />Mikula was correct. <br />
