? <br />Mr. Etzler stated he believed in the Codified Ordinances is a job description <br />of the Administrative Assistant. <br />Mrs. Mikula stated she mentioned that but that it does not agree with what <br />the Charter says. She said the codified ordinance does not list the President <br />Pro Tem as third in command which the Charter does and she feels the Charter <br />supercedes an older ordinance. <br />Mr. Carmen stated she is right. He said the Charter is our Constitution and <br />any laws passed by Council in violation of that are void as illegal. <br />Mrs. Mikula stated she did not feel that under any circumstances she was <br />treated fairly and she has contacted an attorney. <br />Mr. Feneli stated her attorney called him today. <br />Mrs. Mikula stated she is aware that he did. <br />Mr. Feneli stated that Mrs. Mikula's attorney told him we are denying Mrs. <br />Mikula access to information, which he did not feel was correct. <br />Mrs. Mikula stated she was denied access of information. <br />Mr. Feneli asked Mrs. Mikula when she submitted her list of information she <br />wished to obtain to the Village in writing. <br />Mrs. Mikula stated she submitted the written list Friday which is dated <br />February 5th: She stated she requested the information three weeks ago, <br />which could be verified with Mrs. Ruggles, and she agreed to wait until <br />it was convenient with Mrs. Ruggles. She said at Mrs. Ruggles convenience <br />she came, that she did not go into any office, as she feels she has a <br />legal right to do, and request the information. <br />Mr. Feneli asked Mrs. Mikula if it was her understanding of. the law that she <br />can walk in at any time and demand to see books, records and documents and <br />they have to be produced on the spot? <br />Mrs. Mikula stated that it is her understanding that if anybody goes into a <br />municipal office and requests information of public knowledge during the <br />normal bus.iness hours, they are entitled to be shown. <br />Mr. Carmen stated the right is absolute to see the documents, however, it is <br />limited by the convenience of the municipality. He explained that sometimes <br />in a small municipality such as ours it may take time to produce them. He <br />stated he did not know the whole story but if Mrs. Mikula had asked for these <br />things three.weeks ago that is a reasonable length of time, she should <br />have been given the information prior to this. <br />Mrs. Mikula stated she had offered to wait since Mrs. Ruggles was busy and <br />came Friday at Mrs. Ruggles convenience. Ttien she was told she had to submit <br />to this.
