C) <br />? <br />.? . ,? <br />Mr. Carmen stated it was his unclerstanding Mrs. Mikula had changed her <br />requests for information several times so for the convenience of everyone <br />she was asked to prepare a list so the exact information she was requesting <br />could be given to her. <br />Mrs. Mikula asked if Mrs. Ruggles had said she did not know what Mrs. Mikula <br />wantede <br />Mr. Carmen said Mrs. Ruggles did not. <br />Mrs. Mikula stated that in fairness to her that we should have checked with <br />Mrs. Ruggles as she was aware of the things she wanted to see. She stated <br />she had requested the telephone bills at the last Council Meeting and some <br />information she had requested in December. She stated Mrs. Ruggles had been <br />courteous but she complied with Mr. Amendola because he was adamant. <br />Mr. Carmen stated that now we have the list and know exactly what Mrs. <br />Mikula wants he is certain there will be no problem in producing these things <br />promptly. He said Mrs. Ruggles should be able to find these things either <br />Wednesday or Thursday. <br />Mrs. Mikula asked if it is possible to see Mrs. Ruggles and obtain information <br />without submitting her requests in writing. <br />Mr. Carmen stated there is no reason why she would have to prepare a written <br />list. He said he would ask of any resident to give about a weeks notice to <br />be sure we have the time to compile the information. He stated she is clearly <br />entitled to see the information. He said as far as an attorney goes, he does <br />not feel Mrs. Mikula wants to buy a lawsuit, certainly we do.not, and he feels <br />all she really wants is to see the records. <br />Mrs. Mikula stated she does not want to be abused and have someone standing <br />there telling her he is in charge when he has no authority and her tax money <br />is paying his salary and she does not think that is fair. <br />Mr. Feneli stated that f irst of all, he gave the directive to Mrs. Ruggles to <br />get the list of requested items in writing for several reasons. He stated <br />there are so many different laws governing municipalities today in this state, <br />not including Federal law and Freedom of Information (even in a Village of this <br />size) that we could find outselves in serious litigation. He said he is <br />referring to the residents right to see records versus the Privacy Act. He. <br />explained there are certain things that cannot be shown and there are other <br />things that anyone can see. He stated it is his opinion that if we ask <br />for something to be submitted in writing, even though the Public Records Access <br />Act does not say it must be done, that we are justified. He explained if a <br />written list were given to a Department Head they could ask the Law Director <br />if the information could be given and they could write on the list "ok from. <br />the Law Director'.' with the date and should any information be given that should <br />not have been given, the Department Head would be excused as they relied on the <br />advice of the Law Director.
