<br />Mrs: Mikula stated she did not have a problem until she was asked to put <br />what she wanted in writing. She stated she believed she went through <br />all the proper channels as Mr. Spellman knew she had an appointment with <br />Mrs. Ruggles on Friday, and it was at Mrs. Ruggles convenience. <br />Mr. Feneli stated when Mrs. Mikula's attorney called he said we had denied <br />Mrs. Mikula access to inforrnation, which she was not. <br />Mrs. Mikula stated she could not get the information as nothing was typed <br />and could not be typed. She stated the only thing she got on Friday were <br />phone bills which she feels is denying her her rights. <br />Mr. Busa suggested this not be blown out of proportion, that the Law Director <br />explained to.Mrs. Mikula her legal rights for a matter of record, and she <br />should be given those rights. <br />Mr. Busa asked Mr. Feneli to summarize briefly Mrs. Mikula's rights. <br />Mr. Feneli stated her questions do not have to be in writing, that the <br />request must be reasonable and we are allowed a reasonable amount of time <br />to comply, based on the prevailing conditions at the time. <br />Mr. Spellman stated we need a def inition of a"reasonable" amount of time. <br />Mr._Feneli stated that cannot be done. It would depend upon all the <br />prevailing conditions at the time (what is being done, who is available, etc.) <br />Mrs. Mikula stated a reasonable time should be determined by Mrs. Ruggles, <br />when she has the time. <br />Mrs. Hanus stated she feels this would be up to Mrs. Ruggles, if she has <br />time to give the information. <br />Mr. Carmen stated he feels if everyone is reasonable there should be no <br />problem. He apologized to Mrs. Mikula if she had to wait longer than she <br />had to and if she had been inconvenienced. He stated we will try to do <br />better in the future. <br />Mrs. Mikula stated she was not objecting to the length of time she waited, <br />she was objecting to the shock and surprise of something that has never <br />happened in this community before, under any other administration. <br />Mr. Howard Schulz, 450 SOM Center Road, stated he would like the Law <br />Director to publicly state what activities our elected officials in this <br />community can engage upon that are not a matter of public recorde <br />Mr. Feneli stated this is listed specifically in Chapter 149.43 of the <br />Revised Code. He stated they pertain to.certain personnel records, <br />record checks on employees as far as their past criminal record, any <br />medical examinations given to any employee, as that is their private <br />information. He stated if the Police Department is conducting a criminal <br />investigation those facts cannot be seen. He stated if he is preparing <br />a case for a litigation matter that his books and records cannot be seen.
