<br />Mr. Van Curen stated he is referring to property just on the other side <br />of the intersection of S.O.M. and Wilson Mills. <br />Mr..Carmen stated they do have access to the right of way. <br />Mr. Van Curen said at the point they were was 30 feet from the center line. <br />Mr. Feneli questioned if they were.following the path of the utility lines. <br />Mr. Van Curen said they were not at the time he saw them. He said that <br />even where the utility lines are if the utility does not have an easement <br />there it could not lease them anymore than the poles, in his opinion it <br />would not give them permission to be on the property. <br />Mr. Feneli stated that unfortunately that is not necessarily so. He said <br />there have been numerous cases decided saying they do have the right to <br />follow the utility lines. He said he is aware of other communities who are <br />f ighting this. <br />Mr. Van Curen said he understands if the Illuminating Company has a broad <br />enough easement that it emcompasses the Cable T.V. people, however, if they <br />do not then the Cable T.V. people are not covered. He said they are not <br />trying to obtain permission. <br />Mr. Feneli said Mr. Van Curen was correct that the Cable T.V. people should <br />not be walking where they please on private property. He stated Mr. <br />Van Curen should either make a complaint directly to Viacom or report it <br />to the Village. <br />Mr. Van Curen said he is reporting to the Village at this time. <br />Mr. Carmen asked if Mr. Van Curen has the name of the foreman. <br />Mr. Van Curen said he has.reported the incident to Viacom and also talked <br />with Mr. Avery. He said Viacom told him the Village gave them a franchise, <br />and Mr. Avery told him they had no right to be there. <br />Mr. Carmen told Mr. Van Curen that if he would give Council the foremans <br />name they will probably be able to get more action as it is specified in <br />the ordinan.ce that they are required to produce identification when asked. <br />He said he believed the Mayor is listed as the complaint officer, so it <br />will be up to the Acting Mayor to contact Viacom to report this. incident <br />and remind them to present identification upon request. <br />Council President Spellman asked if there were any more comments from the <br />floor. <br />There were no comments. <br />Council President Spellman stated there will be an Executive Session following <br />tonights meeting.
