a {> <br /> <br /> <br />Mr. Busa asked if the residents of the paved portion of Beech Hill could <br />sue the Village for imposing an easier solution to the road problem for <br />the other section of Beech Hill. <br />Mr. Feneli explained the residents of the paved portion of Beech Hill <br />petitioned for the paving so that is a different situation. <br />Mr. Feneli said.he is leery.about maintaining the road in the "as is" <br />condition. He feels either method of payment.for the maintenance would <br />eventually get out of hand. If the road is in the condition he understands <br />from conversations with the Building Commissioner.and Engineer, it is on.ly <br />a ma.tter of time before the road is gone and so.eventually paving will have <br />to be done. <br />A resident asked if Mr. Feneli had been on Beech Hill lately. <br />Mr. Feneli said he was on Beech Hill about.two years ago. <br />Mr.s. Hanus said she was..on Beech Hill today and it was terrible. <br />A resident asked if in the event someone was seriously hurt on Beech Hill <br />(such as a motorcycle accident) if the responsibility would lie with the <br />Village. - <br />Mr. Feneli said the:Village is not responsible for the maintenance of the <br />road at this time. If the mun'icipality was sued by someone who was injured, <br />it would be his position that the homeowners would be responsible, not the <br />Village. He said he cannot say that that would be sustained. He is to <br />protect the municipality,.not the homeowners, and that would be his defense. <br />Martha Gobel - Corner of:Seneea'?ndBeecli'Hill- questioned if there isn'.t <br />somebody who wants to pave the road and get rid of the dirt. Then the trucks <br />coulcl come.through in the winter and the ditches could be fixed and everything <br />would be nice. She said she has lived there 28 years and has.had.it with the <br />"rustic" look. She would like to come into her driveway without dirt on the <br />wheels of her car etc. She feels that eventually the road will be paved, and <br />the cost will be higher the longer it is postponed. <br />Ano.ther resident said she agreed with Mrs. Gobel. <br />Mr. Howard Schulz - asked Mr. Feneli if the Village has the power to induce <br />things of importance that concern the safety, health and welfare of the <br />Village (such as requiring the street to be paved). <br />Mr. Feneli verified that Council does have the power to act on such things. <br />A resident said after living on Beech Hill for.20 years he feels the consensus <br />of most Beech Hill residents for the time being is they are interested to <br />know the projected cost. They would like to know the cost.of maintaining and <br />paving and what that would consist of - how it would be paved, curbing, culverts, <br />ditching - for both cases. They would also like to know the projected costs to <br />the abutting lots.
