Mr. Raia said one of the minutes of the Aintree Park Homeowners Association <br />refers to the bond. <br />Mayor Beebe questioned if anyone had seen this bond and no.one had actually <br />seen it. Mr. Feneli stated he would be very interested to see a copy of the bond and <br />he will do everything he can to locate it. He said references in minutes <br />and correspondence do not mean anything unless the bond was actually posted. <br />Mr. Raia said he was never sent a copy of the bond at the time it was to have <br />been posted. <br />Mr. Russo said there.is a possibility of negligence on the part of the Village <br />if a bond was supposed to be posted and it was not. <br />Mrs. Eloise Maynard said Ordinance 72-45 indicates when the new Aintree streets <br />were accepted for dedication. She read from the December 18, 197.2 minutes when <br />Ordinance 72-45 was passed; "The vote was tied and the Mayor voted AYE. He <br />went on record as saying Mr. Caplan is going to pr.ovide at his own cost material <br />and kabor for repair of the rough section of Beecher'.s Brook. But the affirmative <br />vote for the acceptance of Aintree was chiefly based on the fact that the sewers <br />have proven satisfactory and most of the Aintree sub-division was completed prior <br />to the T.V. sewer photo ordinance. <br />Mr. Russo said he asked a Councilperson about this bond about a week ago. They <br />told them they knew nothing about a bond but would find out within a day or two <br />and he has not yet-received a call back. <br />Mr. Feneli said a Councilperson contacted him last Thursday evening. Since that <br />left one business day until today and he did not have the rest of the background <br />information, he has not yet checked the matter of the bond out. He said with the <br />background information provided by Mr. Raid this evening he will check it out. <br />Mr. Hovancsek commented he was the Village Engineer since April 1969 and he does <br />not reeall ever seeing a copy of the bond. He said it may have been posted <br />back when the sub-division started in 1965. <br />Mr. Busa stated the existence of a bond will be researched. He feels such bond <br />would have been to protect the homeowners as far as the construction of the <br />individual homes are concerned, he doubts it would be for the road itself. When <br />the project was finished, he suspects, if a bond existed, it would have been <br />released because of that. <br />Mr. Russo stated, according to the minutes, apparently the contractor made an <br />agreement with the Village to provide the cost and material for the repair of <br />Beecher's Brook Road and this is what the people on Beecher's Brook Road relied <br />on. He questioned if this could be done. <br />Mr. Feneli said had there been an agreement for the repair of the road, it would <br />not cover the resurfacing now needed.
