?.3 ? <br /> <br /> <br /> <br />Council President Spellma.n stated he has n,ever received any complaints <br />regarding Ken's Auto Bodyo <br />Mayor Beebe reported discussion was held at the Planning and Zoning Commission <br />meeting this evening and they have no objections to renewing this permit. <br />However, the question was raised as to the true ownership of Ken.'s Auto Body. <br />They agreed to recommend passage of this resolution to Council providing Mr. <br />Feneli clarify ownership.. Mayor Beebe-suggested.Council allow a three day <br />extension of the permit so Mr. Feneli could research the matter and the <br />resolution could be adoptPd at the Regular Council Meeting on October 18th. <br />He said he has never received any complaints about Ken's Auto Body. <br />Council agreed with Mayor Beebe. <br />Mr. Busa po.inted out that-Sections 7 and 11 on page 3 of the resolutian <br />dictate that Planning.and:Zoning has the power.to approve and suspend such <br />permit. He stated the-Planriing and Zoning Commission can only make ' <br />recommendations ,to Cauncil, Council must make the f inal decision. <br />Council agreed the resolution shoulcl include Council on page 3 under Sections. <br />7 and 11. <br />Resolut.ion 82-81 given f irst reading. <br />Resolution 82-82, entitled; "A IzESOLVTION AUTHORIZING THE SETTLEMENT OF <br />LITIGATION BROUGHT AGAINST THE VILLAGE BY J. ROBERT COTTON AND JOAN K. COTTON." <br />Introduced.by the.Mayor and Council as a Whole. <br />Council President Spellman stated this ca'se.has been in litigation for over <br />two years and reviewed and discussed by Council many times. <br />Mr_. Busa, seconded by Mrs. Bloom, made a motion to suspend the rules of Council <br />requiring a resolution to be read on three separate occasions. <br />Council President Spellman asked if there was any discussion. <br />There was none. <br />Roll Call: AYES: All <br />NAYS:: N.one <br />Motion Carried <br />Rules Suspended <br />C,ouncil President Spellman, seconded by Mrs. Bloom, made a motion to.adopt <br />Resolut'ion 82-82. <br />Council President S.pellman asked if there-were any comments for discussion. <br />Mr. Busa asked if the Law Director felt it would be beneficial for the Village <br />to make this settlement. ,
