Regular Council Meeting
14-21 4/18/88 - Page 12
Jeanne Leppla asked if they thought the wording on the agreement could be
made a little more specific so that they're protected and don't have to go
to every meeting to see what they're doing.
Mayor Carmen said that you have elected people who are supposed to protect
your interests. He said
he thinks that they have done a good job in getting the residents almost
everything they want in this agreement.
Mre -Rife said they are asking throught the petitions that Council would
honor the Worton-Pinetree Park Homeowner's Association to shelve this until
the whole thing is committed to.
Mayor 'Carmen explained that there is a recommendation from Planning and
Zoning before Council 'to approve the plan. It's now up to Council to vote
on whether they wish to accept or reject the recommendation of.Planning and
Zoningm ;
Mr. Rinker said he would like to make this contingent upon the relocation of
the signs. He said said that he would want to see the computer listing on
the f ourth housem
Mayor Carmen said if a motion would be made, it would be contingent upon
compliance with the sign ordinance.
A brief discussion was held.
Mayor Carmen clarified ?that Council is voting to accept the recommendation
of Planning and Zoning as ise
Mre Petschauer said he believes we are all in agreement that one of the
major elements in this agreement is the obligation that Progessive has to
list the four homes in question. He asked if the four contracts signed by
Progressive fill that elemento
One or two members of the audience said no,
Mr. Rinker moved that Council vote on the acceptance subject to the
conditions:
1) That it meet the specifications f or the sign ordinance
2) That the f ourth house, although listed per agreement
is not on the computer, that that also be accomplished.
Mr. Petschauer said he agrees with that contingent upon the listing of all
four homes in the computer.
Mr. Feneli said the final contingency is the same one that carried 'along
with the Planning and Zoning recommendation, they had a contingency attached
which dealt with a deed restriction on the properties over which the buffer
will encroach.
Mr. Rinker, seconded by Mr. Flynn, made a motion ?to accept the plan
with the above-mentioned contingencies.
Roll Call: AYES: All
NAYS: None Motion Carried
Plan Accepted With Contingencies

I
?
