1,34 <br />Regular Council Meeting <br />10/17/88 <br />Page 6 <br />Mr. Basile asked what the pleasure of Council was regarding the 5' <br />variance. <br />, Mr. Ramos said that he did not know that Council was going to act on <br />this this evening. He said that this would have to be done by <br />resolution--not by motion. He said that he had not been given <br />instructions to draft legislation. Mr. Ramos said that if Council <br />decided to act on the variance, they might want to call a Special <br />Council Meeting in a couple of weeks. <br />Mr. Flynn requested that a resolution be drawn up as soon as <br />possible. <br />Mr. Robert Schulte, Planning and Zoning Commission Chairman, (in the <br />audience) said that he scheduled a Workshop Meeting for this <br />Thursday because he thought that Council was going to vote on the <br />Progressive variance tonight. He said if they vote no, then he will <br />cancel the meeting. If they will not be voting on the issue, he said <br />that he sees no reason for him to hold the meeting on Thursday. <br />Mr. Flynn stated that he would like to move the question; Mr. Basile <br />seconded the motion. <br />Mr. Flynn withdrew his request to prepare the resolution. <br />Mr. Flynn said that if there were conditions written and agreed to <br />that if a determination were made tonight that there be contingent <br />conditions. <br />Mr. Basile said that Progressive has agreed that they will purchase a <br />new fire pumper. <br />Mr. Hovancsek said that, regarding the preliminary plan, that they <br />have indicated that they will comply with all the items we have <br />requested. He said that he will review the final plan when it comes <br />in and that he may have other objections. <br />Mr. Rinker said that he feels we may be putting the cart before the <br />horse and that he is reluctant to vote on something when he feels <br />that there are specifications the Village Engineer wants met. He <br />asked what the process was --if later on that Mr. Hovancsek would be <br />the only person that would consider the final plan. <br />Mr. Hovancsek said that the final plan will go through the same <br />procedure before the Building Commissioner will be instructed to <br />issue the permit. He explained that this was like a concept plan <br />approval. <br />Mayor Carmen said that it was his understanding that they are here on <br />a very narrow issue tonight and that is, is the Village of Mayfield <br />willing to grant them a 5' height variance to build this building. <br />He said that if we say yes to that we don't waive any of our rights <br />with respect to anything else in terms of their meeting code <br />requirements. Mayor Carmen said to the extent that people still have <br />questions with respect to that, that is up to you.
