74 <br />with them. He explained the problem with the ditch is caused from a willow <br />tree on the northe=-_property. The roots of that tree have caused the <br />stream to slowly close up. <br />Mr. Etzler asked if it was the responsibility of the Village or the home- <br />owner to maintain that water flow. <br />Mr. Feneli said it is normally the responsibility of the municipality to <br />maintain the surface water drainage system. It°.is up to the property <br />owner not to allow the water course to.become obstructed. <br />Mr. Amendola said there are more protilems that exist further down the <br />stream and it should be seen. <br />Further discussion was held. <br />Mayor Carmen asked.Mr. Amerid"o.la and Mr. Hovancsek to put together a list of <br />problem drainage areas. Then, a special meeting would be held to go out <br />and look at the.se areas and discuss them. <br />Mr. Petschauer suggested Council also meet w=th the immediate property owners <br />involved. <br />Mr. Feneli requested permission to work with Council on this project. While <br />problem areas are being reviewed, he could determine whatr:must be done <br />in order to gain access to properties, etc. He could also determine <br />whose responsibility it is to perform the work. <br />Mr. Flynn suggested a drawing lie ma.de of the immediate problems. <br />Mr. Etzlerr-:said.the point we are at now is whether the Village is going to <br />step in and open up the area around the willow tree. <br />Mayor Carmen asked if this was the recommendation of Mr. Amendol.a and <br />Mr. Hovancsek. <br />Mr. Amendola asked who would get him the right to enter onto the property. <br />Mr. Hovancsek explained at this time there is.:no easement and no right of <br />entry. Mr. Etzler asked if there were any objections from Council to let Mr. <br />Feneli step in and achieve that end. . <br />Mr. Goley said, only in that there was another problem discussed previo.usly <br />as far as encroachment on Mr. Piunno's property. <br />Mr. Hovancsek explained there is no encroachment. There is a five foot <br />easement on the property south of the Hanus property.
