Mr. Etzler said he is not sure that it * '-is Mayfield Village <br />government, or any government entity that belongs in the private sector <br />to control things like this. <br />Mayor Carmen said in looking into this, he feels the reason why people <br />primarily do not get no smoking tables etc. is because they are not <br />offered as an option. He checked with the manager of Bob Evans Restaurant <br />(who offer non-smoking sections) who told him that they have a greater <br />demand for their non-smoking sections. They started the non-smoking area <br />in a smaller percentage which grew with need. Mayor Carmen said he talked <br />to.Nancy.at the Holiday Inn who said they have 10% non-smoking rooms, and <br />never have a great demand for them. Mayor Carmen said.he tried twelve <br />times in the last two weeks at Hbliday Inn (local and national number) <br />and not once was he offered a non-smoking room. He said perhaps there is <br />no.great demand because they are not offered as an option. Mayor.Carmen <br />said he has a problem with excessive regulation by government. The areas <br />that the government does regulate are regulated for health and safety reasons. <br />We want to make sure that people are safe in the place where they work <br />and where the danger to them is at a minimum. He feels that is precisely why <br />we look at this type of a law, because they are trying to make the envir- <br />onment safer for everyone. <br />Mr. Petschauer commented on other areas of government regulation and <br />said.that he feels there is validity in pursuing this type of regulation <br />since it affects the health and welfare of everyone. <br />" Mr:'Carmody - said the ordinance excludes government operations, restaurants, <br />that seat less than 30, and bars. He questioned why with these exclusions <br />he as an employer would be required to have exclusive non-smoking areas. <br />Mr. Goley said he feels people can go to a bar voluntarily, they don't have <br />to go there to maintain their livelihood. Mr. Goley thanked the businesses <br />for coming to this meeting. He said he would be willing to work on the <br />ordinance tonight until it gets done, or to schedule another meeting to <br />do so. <br />Mayor Carmen said he thinks we need to look at what can be done by an <br />employer to resonably accommodate. his employee without`totally disrupting <br />his business. He thinks there are things that can be done to protect the <br />rights of non-smokers, not adversely affect smokers, and at the same time <br />keep.the inconvenience to business to a minumum. <br />Mr. Dan Spruill said it is known how "sue happy" people are today, and asked <br />who will defend the companies and the Village if they are sued. <br />Mayor Carmen said he feels it does put the Village at risk and cited other <br />area.s of liability they face. He said that we must be aware of that fact, <br />but should not let it guide us. <br />Mr. Andy Ginsburg said that by establishing a standard by which your <br />smoking policy can be measured gives a company one small area of defense.
