119 <br />Mayor Carmen said there have been several articles regarding the Charter <br />Review Commission being denied access to Village buildings to meet, and.our <br />decision to no longer pay the secretary of the Charter Review Commission. <br />He said the reason is simple: the duties of the Charter.Review Commission <br />are completed upon their giving their suggestions for proposed charter <br />amendments to Gouncil and.Council certifying them to Che Board of Elections. <br />It has been some time since that was done. The Charter Review Commission has <br />cor,tinued:-to meet as a body after that time, continued to submit monthly <br />bills for their secretary, and have continued to use Village buildings <br />to meet. Mayor Carmen said he asked our Law Director for an opinion as <br />to whether the Charter Review Commission was still supposed to meet after <br />they have given us.the issues to.go to the ballot. Mr: Feneli did some <br />research and it is his opiniori that once the Charter Review Commissior.?. <br />submits the proposed changes they no longer have a function. Mayor Carmen <br />said he told Mr. Deal that he would be most happy to have him continue to <br />n:eet in.his home, to campa'ign in favor of the proposed charter amendments; <br />he was welcome to do so as a private citizen, but not as a member of the public <br />body using Village funds. Mr. Deal asked Mayor Carmen to get a second <br />opinion from the Law Director. Mayor Carnien said the second opinion was <br />essentially the same as the first. Mr. Feneli said that you cannot use <br />public monies to campaign on behalf of charter amendments. Mayor Carmen <br />said he is opposed to many of. the amendments but that tfiat does not color <br />his thinking., Public monies and buildings cannot be used for private <br />purgoses. <br />Mayor Carmen said he understands that Mayfield Heights has determined to <br />erect their own barrier on the otlier side of Worton Park Drive. He said <br />according to the newspaper articles, Mayfield Heights Mayor DeJohn said he <br />had made a determination because they had not received an answer from <br />Mayor Carmen regarding the placement of a permanent movable barrier. Mayor <br />Carmen said his last comment during the meeting held in Mayfield Heights <br />several weeks ago was.that he would not take any action that would adversely <br />affect a neighboring city. He specifically explained.at that meeting that <br />we had no intention of removing the barrier, we had only one intention in <br />considering the placement of a permanent movable barrier which was to allow <br />access for emergency vehicles if necessary. When it became.clear that the <br />residents in the area did not want it, along with Mayfield Heights, Mayor <br />Carmen said he determined it would not be removed. <br />Mayor Carmen said it has become clear over the past several months that we <br />have some significant drainage problems. He has discussed them with Mr. <br />Hovancsek and the ward councilpeople affected. Mayor Carmen asked that <br />Council consider hiring an expert to assist Mr. Hovancsek in formulaCing a <br />long-term plan to prioritize drainage problems. It could be a five or ten <br />year plan similar to the plan put together for road repairs. The plan <br />would also..call for problems to be reviewed on an annual basis. Mayor <br />Carmen asked that this be included on the next Caucus agenda. <br />COMNNIENTS FROM COUNCIL PRESIDENT ETZLER: <br />Mr. Etzler said.he was requested'to:add two.items?to.the agenda: 1) A <br />motion to approve $2,750 for the replacement of culvert pipe on Thornapple, <br />and, 2) A motion to approve a signal warrant review at SOM and Beta not to <br />exceed $600. He said if,there were no objections, he would like to add <br />these items to the agenda under "New Business." <br />There were no objections.
