It is
easily read in the code under accessory buildings in single-
family districts. -
Mr. Jamieson asked if this property could be rezoned as a
warehouse district.
Mr. Feneli said not without the consent of the electorate; we
have referendum zoning.
Mr. Jamieson said we might do that; we could get a property
devaluation that way, it might help us.
Karl Rouch,_6728 Hickory_Hill_Drive said he can"t believe what
------ --- -- -- -- ---
he's hearing about vested rights and interests. He said this is
the crux of the problem, and you "re mi5sing it. He wished the
Architectural Review Board were here, he'd direct the thing
right at them. He thinks the Mayor has made his point but the
one thing he does not comprehend is that one man who is new in
the Village (two months) has vested interests of $11,000. He
said he has alot inore vested rights in the Village than he does.
He said he is speaking for every one of these people, plus the
rest that haven't shown. You"re talking vested rights--why not
talk everybodys. Why don"t we give him back his little vested
rights,. he does not ca.re how you do it. Mr. Rouch said he has
$11,000 invested, and this thing is a violation against Mayfield
Village. Why don"t we just program so much per individual in
the Village and say let"s give him back.his $11,000, get him
out. Let's stop this thing, cease and desist.
Mr. Feneli said the key issue is not the $11,000 the person has
invested and the money invested in purchasi.ng his home. The key
issue is what is right legally. Qn the day that that person
came in and applied for the building permit, the Village code
said the building could be built that size. Councils are not
allowed to change the laws in midstream. That is the law of
the United States: Mr. Feneli said that Mrs. Klang said at the
first meeting that she would be happy if the Council would do
something so this did not happen to anybody else, and that"s
what Council did by adopting the neia ordinance.
Mayor Carmen said bear in mind that no final decision has been
made. He said he would like all the people present to attend
the next Architectural Review Board Meeting. He said we will
leave a sign-up sheet if they would like to leave their name, we
will contact them to let them know the date of the next A.R.B.
meeting. Mayor Carmen said he has sent a letter to i-.he A.R.B.
urging them to turn it down, and said those present could attend
the next A.R.B. meetina to tell them why you think it's not
consistent with the character of your neiahborhood, and ask them
to turn it down.
