The Board really <br />puts tremendous faith in what Mr. Amendola has to say. <br />Therefore, there was no reason to assume that the Board in this <br />instance would do anything different than they did in virtually <br />any other instance. He said he thinks what Mr. Amendola meant <br />to tell us was that this was really all completed, the Board was <br />going to go with his recommendation. <br />Mr. Klang asked why the Mayor did not check this out, rather <br />than hearing this from a resident; namely his wife. <br />Mayor Carmen said that no one here, including himself is a full- <br />time employee. Accordingly, they rely very heavily on what <br />the department heads tell them. <br />Mr. Klang said, in other words you put.your trust in them. <br />Mayor Carmen said yes, exactly. He said he does not think your <br />trust was breeched here. Mayor Carmen said it was a mistake in <br />judgement. <br />Mr. Klang asked Mayor Carmen how he could say it was a mistake-- <br />it was a lie. <br />Mayor Carmen said a lie to him implies bad faith; it implies I <br />am intending to decieve you and I"m going to. He does not think <br />that's what Mr. Amendola's intent was. . Mayor Carmen said when <br />he talked to Mr. Amendola afterward, he asked if it had gone <br />before the A.R.B. Mr. Amendola said not officially, but <br />they"re going to do what they do in all of these situations. <br />They are going to look at the plans, and go with my <br />recommendation. „ <br />Mr. Klang said all the residents feel that it was an invalid <br />building. permit. Everything should be resubmitted, there"s a <br />new code now, and it should go by the.new code. <br />Mayor Carmen said we understand your feelings, but we must <br />abide by the law. When our,Law Director tells us they have <br />vested rights, we are constrained. The A.R.,B. has the last <br />word. They may tell us, vested rights,or no vested rights, we <br />don't think that this is an appropriate structure. If they say <br />that, the building will not be built. They could say that it <br />is appropriate now, or how it is redrafted. Thep gave <br />suggestions of how the building could be changed to conform <br />more to a residential area. Those changes will have to be made <br />and the plans will have to be resubmitted. Right now, no <br />building permit has been issued, there are no plans currently <br />on the table for the A.R.B. to look at. They have to make <br />changes.
