208 <br />IZegular Council Meeting <br />12/17/90 _ <br />Page 4 <br />OLD BUSINESS <br />ZJpper Forty U12date - Mr. Hovancsek said he met with Dick Curver from Metroparks, and two <br />representatives from URS Consultants. They started working on the project today. He hopes to <br />have the plan completed and ready for presentation for the Regular Council Meeting in January. <br />He will be holding another meeting in a few weeks with URS Consultants and the Metroparks <br />representatives. The Metropark has offered to have people in the field as they do the study. Mr. <br />Hovancsek said that it seems to be a cordial relationship thus far. Mayor Carmen said <br />URS Meeting,,Update - Mayor Carmen said a meering was held two weeks ago. He said they <br />wanted to know what we were looking at the storm water utility to do. He said we should get <br />some initial information back by the end of the year. Mayor Camien asked Mr. Hovancsek to <br />check with them about the project cost and to review their net profit number versus the revenues <br />we could feasibly expect to collect to get a net number. He should try to get this by the end of the <br />year. Mr. Hovancsek will also invite Dave Pyzoha from URS to the January 14 Council Caucus. <br />Hanover Woods Resident Meeting - Mayor Carmen said he talked to the Hanover Woods <br />residents. They are fornung a Hanover Woods Home Owner's Association. He said the Village <br />sent letters regarding the resident's swales and tree lines that were not in conformity. He said they <br />determined: 1) that the developer may or may not have sent out information to all residents advising <br />them of the swale requirements and 2) that the residents received varying information from the <br />developer and from the Village. Consequently, Mayor Carmen said he suggested that Mr. <br />Hovancsek re-think his position in making everyone comply. He said they have determined that <br />where the trees have been planted will be fine. In respect to the swales -- if the difference is under <br />6 inches, they will let them slide. <br />Mr. Hovancsek said he feels the swales will be sufficient to drain if they are within 6 inches of the <br />required size and does not foresee any problem if they are within that range. <br />Mayor Cazmen said that approximately 75-80% of the homes will fall within this range for their <br />swales. <br />IVIrs. Mills asked what would happen if the swale silts in. <br />Mayor Cannen said we do not have "swale police", however, if the swale silts in, problems with <br />water sheeting across the property will be experienced. He said the responsibility, by deed <br />restricrion rests with each property owner. He said that maybe when the Village completes its <br />routine inspections, it will randomly check swales. Mayor Carmen said that most residents do not <br />understand that it is their responsibility to find out what they can and cannot do. <br />Mr. Fietrafese said he thinks maybe the Village should require that the developer inform new <br />residents of requirements. The Village could possibly enact a notificarion ordinance that requires <br />the developer to relay information to the builders of the lots and to the owners of the homes. <br />Mr. Flynn said he was notified of a landscaper who tried to get information on the swales and trees <br />who said he talked to someone at the Building Departrnent who told him it was a11 right to place the <br />trees where they were placed.
