?09 <br />Regular Council Meering <br />12/17/90 <br />Page 5 <br />Mr. Hovancsek said the Village sent a memo to the resident stating that the trees should be 13' off <br />the pavement. Most trees were placed 13' 6" back or more. <br />Mr. Flynn asked if we could put something in writing. Trees should be spaced 35' apart according <br />to the deed restrictions. <br />Mayor Carmen explained that the home owners experienced problems because they did not know <br />where the trees were to go. If someone from the Building Department told them it was o.k. he <br />feels uncomfortable telling them different He said it makes some sense if they were told to line the <br />trees up with the others--and if those are wrong, that is why they aze wrong. Mayor Carmen said <br />if the trees are a half foot to a foot off; we can live with that. <br />Mr. Amendola explained regazding the first property developed on that street--the property owner <br />was told nothing at that time about where the trees should go. So when they got ready to plant <br />their trees, they tried to talk to Mr. Caplan's Off'ice who could not tell them. When the landscaper <br />came, they put them in where they thought they should go and they will not move them. <br />Mrs. Mills said she thinks the residents in Hanover Woods should receive copies of the ordinance <br />after it is passed. <br />Heinen's Incinerator Permit - Mr. Ramos said he hoped Council had a chance to review the letter <br />from Cleveland to Heinen's. He said that Cleveland, in conjunction with the Ohio E.P.A. has <br />required performance and stack tests on the Heinen's incinerator to see if there was a problem. <br />There was something wrong and accordingly the permit was not reissued. <br />Mr. Ramos said he wrote a letter to Cleveland asldng that if the pernut is renewed it be renewed on <br />condition that each year Heinen's be examined to see that they remain in compliance. He said the <br />permit was not renewed at this time because it was obvious that there is some problem. <br />Ridgeburv Blvd. Improvement - Mayor Carmen asked if we had received another copy of the <br />letter. <br />Donna said no, we have not. <br />Drainage Structure on Wilson Mills Road -1VIr. Hovancsek said they have been working on the <br />plans. The structure is 25' deep; he hopes to have an estimate by the next Council Meeting so we <br />can go out for bids in January. <br />Second Readiniz of Ordinance No. 90-44, enrided; "AN ORDINANCE ENACTING CHAPTER <br />1345 OF TBE CODIFIED ORDINANCES OF MAYFIELD VILLAGE, OHIO, PERTAINING <br />TO GARBAGE DISPOSALS SYSTEMS REPEALING ALL ORDINANCES INCONSISTENT <br />HEREWITH, AND DECLARING AN EMERGENCY." Introduced by Mayor Camien and <br />Council as a Whole. (First Reading 11/19/90) <br />Mr. Ramos said he thinks Council should table or defeat this ordinance so that we can give it a new <br />number and act on it in 1991. <br />Mr. Flynn, seconded by Mrs. Cinco, made a motion to suspend the rules of Council requiring an <br />ordinance to be read on three sepazate occasions.
