They cannot do anything after the next <br />meeting. Council will need 5 affirmative votes to override the Mayor's <br />veto. <br />Roll Call: AYES: Mr. Basile, Mrs. Cinco, Mrs. Mills, Mr. Rinker, <br />and Mr. Santoro <br />NAYS: Mr. Flynn Motion Carried <br />Ordinance Tabled <br />Mr. Flynn asked if Ordinance No. 89-31 would be on the agenda for the <br />next Regular meeting. <br />Mr. Basile said yes. <br />Mr. Flynn asked about Beech Hill. <br />Mr. Ramos said there is a pre-trial scheduled on the 20th or 21st. He <br />will be meeting with Mr. Hovancsek to discuss their proposal. <br />Mayor Carmen asked if all members of Council were aware of the proposal <br />made by the Sewer District. <br />Everyone said yes. <br />Mayor Carmen said that the Sewer District agreed to front the dollars <br />if we will agree to put in a tap-in fee so that people who now build <br />and would tap into pump stations will have to pay an access fee: He <br />said that Fred Ramos is checking into this because there were no <br />parameters or time frame set. <br />Mayor Carmen said he told them to draft proposed settlement papers. <br />He said the Sewer District had said they do not think this is the <br />answer to the problem but it will improve it up to Hanover Woods. <br />Mr. Basile asked if there was any other matter to come before Council. <br />Mr. Basile asked Rita Mikula, in the audience, if she had a comment. <br />Mrs. Mikula asked if there was anything in this municipality that <br />differentiates residents rights if you live on a main thoroughfare <br />versus side streets. Are residents on side streets entitled to <br />privileges but people who live on main thoroughfares are not equal and <br />deserving of being accommodated? Is there parameters written in law <br />that main streets are not equal to side streets? <br />Mayor Carmen said there is an equal protection clause but the only <br />problem is if there is a rational basis and we cannot provide the same <br />service at the same or close to the same cost to other residents. <br />Mrs. Mikula asked if this meant not to service a certain area with a <br />provided service.
