44 <br />Regular Council Meering <br />3/16/92 <br />Page Six <br />Mrs. Cinco, seconded by Mr. Busa, made a morion to suspend the rules of Council <br />requiring a resolurion to be read on three separate occasions. <br />ROLL CALL; AYES: All <br />NAYS: None <br />Mr. Rinker, seconded by Mr. Fixler, made a motion to adopt Resolution No. 92-15. <br />Mr. Flynn said that everything went fine, there were no irregulariries. <br />ROLL CALL: AYES: All <br />NAYS: None <br />First Reading of Ordinance No. 92-06, enritled; "An emergency ordinance authorizing an <br />addirional expenditure for concrete sidewalk work to DC & Sons. Introduced by Mayor <br />Pietrafese. <br />Morion Carried <br />Rules Suspended <br />Morion Carried <br />Resolution Adopted <br /> <br />Mr. Busa, seconded by Mr. Ferrante, made a morion to suspend the rules of Council <br />requiring an ordinance to be read on three separate occasions. <br />ROLL CALL: AYES: All <br />NAYS: None <br />Morion Carried <br />Rules Suspended <br />r] <br />L <br />Mr. Ferrante, seconded by Mr. Basile, made a morion to enact Ordinance No. 92-06. <br />Mr. Basile asked what addirional work this was for. <br />Mr. Diemert explained that the contractor completed this project in November 1991. He <br />alleges we had caused the delay in him getring the work done and then forced him to do the <br />work in difficult weather. Many of his claims we contest and dispute although some things <br />could be justifiable; we feel the $1605.50 is justifiable. The check will not be written unril <br />he has finished the seeding, landscaping, and repair of an apron. The check will be written <br />to he and Carr Brothers. <br />Mr. Fixler said he thought the delays were because he did not get back to us. <br />Mr. Diemert said rather than get into a legal dispute we feel this is the best way to close it <br />out. <br />ROLL CALL: AYES: All <br />NAYS: None <br />Morion Carried <br />Ordinance Enacted <br />
