68 <br />Regular Council Meeting <br />5/18/92 <br />Page Two <br />Mr. Rinker questioned who advised her of that. <br />Mrs. Sullivan stated that Mr. Amendola had been out and talked to her about it, Mayor Pietrafese <br />came out and looked at the situarion. Pat Flowers from the County was also there. <br />Mr. Rinker questioned what Nir. Flowers' tide is and what did he say? <br />Mrs. Sullivan stated she did not know what his title was, but he is with the County Engineers <br />office. He checked the main line and it is cleared. <br />Mr. Rinker stated it is his understanding there is a line that runs down the street between Mrs. <br />Sullivan's property and Mr. Wilson's property. They both tie into that one line. It then goes into <br />the Metro Paiks properey. <br />Mrs. Sullivan agreed and staxeci there is also another line on the opposite side of her house. It is an <br />uncovered pipe. <br />1VIr. Rinker questioned the easement she referenced. <br />Mrs. Sullivan stated there is no easement on her deed to the property and she questioned if there is <br />such an easement. Obviously there is no such thing. As far as they are concerned, they are going <br />to fill those ditches with dirt to take caze of the situation. She has four kids and other kids from the <br />neighborhood play on her property. They have reached a point that they will not put up with the <br />situarion any longer and shouldn't have to. <br />Mr. Rinker stated it is not much comfort, however, they are well awaze of the drainage problems <br />throughout the Village and this is one of them. They have some major problems with trying to <br />rehabilitate the whole storm water system that was built a number of years ago. They have been <br />almost victimized as much as individual property owners. He is aware that Mr. Amendola, as well <br />as Mayor Pietrafese, have been checking into this further and trying to figure out what the problem <br />is. It was his understanding a contractor was to be on the site today. <br />Mayor Pietrafese stated he had talked to Mr. Amendola this morning and understood there was <br />some problem and he was not able to start. <br />Mr. Amendola stated he plans to call him tonight to see when he can start. <br />Mayor Pietrafese stated the contractor is going to explore the area to see what the problem is. <br />Mr. Rinker stated the Village is very sensitive of the fact that although they want to be helpful, <br />there are certain problems that are the responsibility of the property owner. They look to their <br />I.aw Director and people who understand what the legalities are as faz as the responsibility. They <br />must deternune if the responsibility is a shared one or separate. One of the most difficult decisions <br />with this kind of a problem is that it is underground and it is not easy to deterniine what the <br />problem is and who is responsible. Traditional right of way easements are no problem; when on <br />private property it must be determined who is responsible as they have problems all over the <br />Village and must be cazeful not to exceed the Village's responsibility and avoid working on private <br />property. <br />T'hey try to resolve problems as they arise and realize they will be doing band-aid work <br />until such time that all azeas are taken care of.
