69 <br />Regulaz Council Meeting <br />, <br />5/18/92 <br />Page Three <br />Mrs. Sullivan stated that she understands their position, however, she feels she has been patient <br />and cooperative but it has now reached a point that waters from the street are draining into the pipe <br />and hers is not. Mr. Rinker stated that it is his understanding that the street and the two properties are draining into <br />the pipe which is part of the system. <br />Discussion was held on the pipes draining into the system and Mr. Rinker stated that the problem <br />they are trying to resolve is where the problem exists. It is his understanding her pipe ties into the <br />pipe well beyond the Village's right of way and on her property. <br />Mr. Rinker asked Mr. Diemert to look into the existence of an easement. <br />Mrs. Sullivan said there is no easement and she is not going to pay for it <br />Mayor Pietrafese stated that he was not aware of this problem until debate of his campaign and he <br />will follow up on this, just as Patsy would have. They will find out what the problem is without <br />encroaching on responsibility that is not the Village's. <br />Mr. Rinker stated they are hoping to work together and establish who is responsible and correct the <br />problem. However, most of the time when the responsibility is established, most residents have <br />not been happy with the end results. <br />Mr. Basile stated that every time the Voice of the Village goes out he puts an article in it asking <br />people to call him if they have a problem. The day after the debate, he called Mrs. Sullivan and left <br />a message on her machine and never heard from her and was ?not aware of the problem until that <br />point. <br />Mrs. Sullivan stated Mr. Basile did call in November and apologized for not getting back to him <br />because she had a death in the family. At that point, she decided to give Mr. Pietrafese the <br />opportunity to take caze of it. <br />Mr. Rinker stated that everyone is working on the problem and asked for cooperation. <br />Mr. Fixler questioned what work is going to be done? <br />Mr. Rinker stated the only way to trouble shoot this job is to dig. <br />Mrs. Sullivan said this is not her only problem. <br />Mr. Rinker stated Mr. Amendola is constantly putting articles in the Voice of the Village regarding <br />cleaning up yazd debris. This is a rural community and the only way to drain properties is <br />eliminate with open swales and the debris must be removed The Village is responsible in the right <br />of way and the residents must do their part. Most of the time when the responsibility is <br />determined, the homeowner is not happy with the end results. <br />Mrs. Sullivan said when the Counry tested the drain, there was raw sewage. <br />Mr. Rinker stated whole neighborhoods are effected, not just one lot, and the Village will follow <br />through.
