157 <br />Regular Council Meeting <br />9/21/92 <br />Page Seven <br />Mr. Basile said there was production in that building; the warehouse was only a small part of it. <br />Mr. Panzica said he understood it was used as a warehouse building also. <br />Mr. Fixler asked if a cap could be placed on the number of delivery trucks per week. <br />Dan Galler. Fish Furniture (in the audience) - Mr. Galler said they would average approximately <br />25 trucks a week, not counting their trucks. All receiving would occur between 9-9:30 a.m. and <br />4:30 p.m. He said there will be 3-4 men in the building who will unload the truck and put the <br />items away. They will open the furniture and inspect it for the next day's delivery. They have two <br />delivery trucks with a 22' box which would be pazked at the rear of the building. They will pull <br />out about 8 a.m. and return between 4:30 and 5 p.m. They receive some items from third parties. <br />Some days there are no delivery trucks, some days there could be 3 or 4; on a high day there could <br />be 5-6 trucks. Also, U.P.S. and R.P.S. trucks come once daily. There is more than adequate <br />room behind the building for the vehicles to turn around. <br />Mr. Diemert said this would be a non-confomung use. According to the lirigation involving Don <br />Ray Products, it was held by the Courts to be office-laboratory use, not production-distribution. <br />As far as the Courts were concerned (as far as the litigation), he does not know of any occupancy <br />permits for warehouse use. A variance would be necessary to permit this limited use for a <br />warehouse. Mr. Diemert said Council could include conditions and a time limit in the variance. <br />. Mr. Diemert advised Council this could be used against the Village later on as evidence if the <br />Village permits this kind of use there. <br />Mr. Rinker asked Mr. Galler for a realistic figure on the number of trucks weekly. <br />Mr. Ga11er said there would be about 30 third-party tnicks per week; 4-5 daily not counting their <br />trucks. <br />Mr. Fixler suggested a time limitarion and suggested the number of trucks be monitored. <br />Mr. Rinker asked what period of time were they looking for if Council would allow this use on a <br />limited basis. . <br />Mr. Galler said they were looking at a six-year lease; however, one year would be satisfactory. <br />Discussion was held. Mr. Rinker asked how they felt about waiting unril October 5 to consider this request. <br />Mr. Ga11er said they would like to get moving by October 1 st. <br />Mr. Basile said he did not feel the Planning and Zoning Commission members would change their <br />mind if asked to reconsider the variance request. <br />Mr. Diemert cited several terms to be included in the motion to grant a variance to the applicant <br />(Fish Furniture) for a one-year term expiring October lst, 1993, to a11ow a warehouse not to <br />exceed delivery trucks of 20 per week. When a motion is made, it will be pursuant to the terms <br />that will be prepazed by the Law Director and attached to the minutes as a permanent record.
