179 <br />Regular Council Meeting <br />10/19/92 <br />Page Eleven <br />Mr. Diemert explained why a variance is required (instead of a Special Use Permit). He said under <br />the Village Charter (regardless of defuririons otherwise found in the code) Council has the authority <br />to put condidons on its variances and make them as restrictive as it pleases. Mr. Diemert said the <br />variance is to be with the conditions stated and they must also get an occupancy permit within 30 <br />' . days or the variance is null and void. The variance is to be identified as for Fish Furniture. <br />Mr. Ferrante, seconded by Mr. Fixler, made a motion to grant a three year conditional variance to <br />Nacy Panzica for the property at 500 S.O.M. Center Road, formerly known as the Don Ray <br />Building, for the purpose of allowing Fish Furniture to use same as a warehouse upon the <br />expressed terms and conditions as set forth in the Law Director's letter of September 28, 1992, <br />directed to Nacy Panzica. This variance is granted upon the further condition that same will <br />comply with the Fire Chief s letter and requirements, and upon the further condirion that any <br />violation of the terms or conditions may cause termination of the variance after thirty days advance <br />notice to Mr. Panzica, and his failure to cause correcrion to those violations. <br />ROLL CALL: AYES: Mr. Busa, Mrs. Cinco, Mr. Fenante, Mr. Fixler, Mr. Flynn, and <br />Mr. Rinker <br />NAYS: Mr. Basile Motion Cazried <br />Variance Granted <br />Mayor Pietrafese asked Mr. Panzica to accept his apologies for the turmoil he had to go through. <br />Mr. Panzica expressed his apologies and thanks. <br />Mr. Rinker said he had two items for Executive Session. <br />Mr. Amendola said he had another item to bring up. Some years ago when Dr. Stabile was the <br />head of the school boazd, they made a deal with him that they could use the community room for <br />voting with the provision they gave us ten feet of land behind the community room for storage. <br />Mr. Amendola said the Village has held up their end of the bargain but the school board has not <br />come through with that ten feet--they want the ten feet. <br />Mayor Pietrafese said the last thing he heard was Mr. Shaylor remembered the agreement and was <br />going to pursue it. He does not know what transpired since then. <br />Mr. Amendola asked if the Engineer could draw up a lot split. <br />Mr. Rinker said yes. <br />Mr. Rinker said the matters for Executive Session are: one concerning property, the other-- <br />pending litigation. <br />Mr. Fixler, seconded by Mr. Ferrante, made a morion to recess into Executive Session. <br />ROLL CALL: AYES: All <br />NAYS: None Morion Carried <br />Council went into Executive Session at 9:24 p.m.
