It is putting into your Codified Ordinances certain <br />language changes based on the change in technology over the past 15-20 yeazs, referencing the new <br />cable acts that have been brought into play that we have to abide by as well as the cable companies, <br />certain Federal regulations that have been adopted by the U.S. Code which we have to abide by as <br />well as the franchisees, the franchise fee provisions, public and educational and governmental <br />programming requirement that the grantee has to follow, how gross revenues aze determined and the <br />franchise fees put on that, all aze put into the Codified Ordinances for enforcement purposes and <br />giving more legal strength to all of the codes that impact cable television and the codes themselves. <br />The Committee has gone over all of these and has found nothing objectionable in them and approved <br />them including the various terms (which are no different than the contract itself.) <br />Council President Marquardt asked if there were any questions or comments. <br />There were none. <br />Roll Call: AYES: All <br />NAYS: None <br />Motion Carried <br />Ordinance Enacted <br />First Reading of Ordinance No. 2000-39, "An emergency ordinance enacting new Chapter 946 to <br />the Codified Ordinances of the Village of Mayfield relating to customer service standazds for cable <br />television systems." Introduced by Mayor Rinker and Council as a Whole. <br />Mr. Busa, seconded by Dr. Pazker, made a motion to suspend the rules of Council requiring an <br />ordinance to be read on three separate occasions. <br />Roll Call: AYES: All <br />NAYS: None <br />Motion Carried <br />Rules Suspended <br />Mr. Busa, seconded by Dr. Pazker, made a motion to enact Ordinance No. 2000-39. <br />Mr. Diemert said this was a recommendation from the Cuyahoga County Mayors and City <br />Managers. In their dealings with cable television in the past, when there have been interruptions in <br />service and other non-responsive behavior by the cable companies, we didn't have much teeth other <br />than the contract itself to go after the cable company. This is enacting privacy requirements, service <br />requirements, hotlines, call.lines that have to be available 24 hours a day and establishing the Mayor <br />or his designee to receive complaints from citizens and then follow up on enforcing these codes or <br />any dissatisfaction we might have with the cable company, it gives us some teeth to go after them in <br />our codes. <br />Council President Marquardt asked if the cable company is aware of these. <br />Mr. Diemert said yes; they have approved them as well in their procedures. <br />
