Regular Council Meeting <br />8-18-08 <br />Page 14 <br />standards which say you need `x' amount of surface acres to support a single well. The state sets <br />that equation. <br />Ms. Leone asked if they have met their requirement as of now. Mayor Rinker said they have. <br />Ms. Leone asked if the well is definitely going in. Mayor Rinker replied they have told us it will. <br />Ms. Leone asked when. Mayor Rinker replied that we don't believe they are going to drill until <br />we negotiate an agreement because by negotiating with us and being able to acquire acres which <br />include our 10 acres toward that count that allows them more flexibility in drilling another well <br />in a different location. One of the things Ms. Calta talked about tonight was we have requested <br />but not received information that tells us where that other well is supposed to be. We know it is <br />outside of Village property, but we don't know where it is. <br />Ms. Leone asked if this property is crucial to continuing any other wells. Mayor Rinker replied <br />it is crucial to continuing wells outside of Mayfield Village, but it is not crucial as to whether or <br />not they drill this well. They are telling us they will drill this well with or without us. With us, it <br />gives them better flexibility than knocking on someone else's door. <br />Ms. Leone said if you do put this property in, there will be other people affected by it. Mayor <br />Rinker replied, yes. Ms. Leone added other people can join up on the other side and we can <br />continue down through Glenview and Beech Hill. Mayor Rinker said if people want to sign up <br />they have that right, that is exactly correct which is why the other discussion we have had is <br />whether creating some type of a consortium type of organization, almost like a public <br />corporation would enable us to regulate that domino effect if you will. <br />Ms. Leone said when you consider this property if you do put that in to the lease, it will affect <br />the other people down the road. Mayor Rinker said he thinks if anything, and he can only <br />speculate by our agreeing here, at least in the near term our understanding is they go south, they <br />don't go north, but there is no guarantee that they won't be looking. They have been looking in <br />this market for the last several months and will continue to do so as they are entitled to do. <br />Mayor Rinker was asked if he was able to stipulate they go south. Mayor Rinker said he cannot <br />control that and he won't. The best way we can manage this is by engaging in the dialogue and <br />trying to negotiate something at arm's length that we feel we can at least get some value out of <br />this. We are not going to stop the well drilling, we may direct some of the locations, but even <br />that is highly speculative. A lot of it is a function of what people want to negotiate individually <br />because that is their constitutional right. The state says it is a state policy to promote this well <br />drilling along these formulas. <br />Wes Marrotte <br />6804 Glenview <br />Mr. Marrotte asked that if the Village kicks in their 10 acres, are they allowed to drill underneath <br />the three properties that have not signed on?
