Regular Council Minutes <br />6-28-04 <br />Page 11 <br />he is very knowledgeable about it but also, he has worked with so many other cities and has seen <br />some of the roads not to go down. So I can think he can prevent us from putting our foot in our <br />mouth or our foot in a hole. So I think the idea of having him in is a good one. He is unavailable <br />on and off for the next couple of weeks. When he gets back, we will probably have a meeting <br />and will have a complete report on it then. Again, I do not know where it stands-but we have <br />to talk to Phil or Mr. Diemertjust tell Adelphia--I don't know where we proceed from here. <br />Just tell them we want it, and to put it in. <br />Council President Buckholtz asked Mr. Diemert, do we have to pass something? It's in the <br />contract that we passed. <br />Mr. Marrie said no; I think it's just a matter of them saying to us to go. <br />Mr. Diemert said yes, that is what they were looking for is direction-whether we'd change our <br />mind on the money or the goods. <br />Mr. Marrie said he suggested-and we talked about it at the last meeting-he suggested- <br />actually more than one person at the meeting [suggested] just take the money rather than the <br />goods. You have your choice because the school can get you far more modern equipment for the <br />money than what they would give you just for the equipment itself. So you are better off taking <br />the money. The school is definitely taking the money for their half share. In conversations at the <br />meeting that I heard-it was pretty much universal that you are better off taking the money and <br />going your own route instead of taking the equipment they are going to give you. The School <br />Board feels some of it-they won't call it outdated-but it is not the most current equipment. <br />And they offered to go ahead and act as our liaison for purchasing the equipment and a guide and <br />aid if we need it. <br />Mayor Rinker suggested Mr. Marrie talk to Frank. <br />Mr: Diemert said they are ready to go- <br />Mr. Marrie added: they just need us to say we're going to take it and I think that's what I am <br />asking for now. <br />Council President Buckholtz asked, since we are going to amend the agenda under New <br />Business, would it be appropriate to just do a motion? <br />Mr. Diemert said we did examine whether or not we could get better cable or upgrades and they <br />didn't want to hear any of that-- <br />Council President Buckholtz said I had Joe send me copies of minutes of that meeting, and the <br />contract because I was concerned with who owns what. I would rather own it all, but the way it <br />reads is they will own the fiber-we are talking about fiber by the way-not cable--and they will <br />own the fiber and they will maintain the fiber to each building and we will own the fiber and we <br />will maintain the fiber that is in the buildings. So, they run it to our buildings and leave it coiled <br />` -' up and then we take it from there. The only thing I was thinking about at that point was, I didn't <br />want to be married to their services if we want to use the fiber for whatever-but there is nothing <br />in that agreement that precludes us from using that fiber to run anything across it that we want to
