Regular Council Minutes <br />9-27-04 <br />Page 10 <br />Motion to Remove from Table; Motion to Amend and Second Readin of <br />Ordinance l~lo. 2004-44, (formerly referenced as Ordinance 2003-43) entitled; <br />"An emergency ordinance declaring improvements to certain parcels of Real Property to be a <br />public purpose, describing the public improvements thereon to make service payments in lieu of <br />taxes, authorizing an agreement with 6685 Beta Associates, establishing a municipal public <br />improvement tax increment equivalent fund for the deposit of such service payments, and related <br />authorizations pursuant to Ohio Revised Code Sections 5709.40, 5709.42 and 5709.43, <br />and declaring an emergency." Introduced by Mayor Rinker and Council as a Whole. <br />(First Reading 12/15/03.) <br />Ms. Calta said it is referenced under 2003-43 but it has been renumbered as 2004-44. It <br />will require a motion to remove it from the table; if you would like to pass, a motion to <br />amend, a motion to suspend and a motion to pass. <br />Mrs. Cinco, seconded by Mr. Saponaro, made a motion to remove Ordinance 2004-44 <br />from the table. <br />ROLL CALL: AYES: All <br />NAYS: None Motion Carried <br />Removed from Table <br />Mrs. Mills, seconded by Mr. Saponaro, made a motion to suspend the rules of Council <br />requiring an Ordinance to be read on three separate occasions. <br />ROLL CALL: AYES: All <br />NAYS: None Motion Carried <br />Rules Suspended <br />Mrs. Mills, seconded by Dr. Parker, made a motion to amend Ordinance 2004-44. <br />ROLL CALL: AYES: All <br />NAYS: None Motion Carried <br />Ordinance Amended <br />Council President Buckholtz asked for discussion on the amendment. <br />Mr. Brett said the only amendments are the number and then I think just some <br />housekeeping measures as far as the name of the entity from 6685 Beta Associates to <br />Skoda, Minotti Properties LLC; the addition of Exhibit C which we had at the end of <br />the ordinance before but did not declare and then just some minor points which I <br />discussed with Bond Counsel; none of which make a substantive change in the <br />implications of the ordinance-so mostly housekeeping, change of number, reference to <br />an Exhibit C in the text. <br />Council President Buckholtz asked, is this the Development Agreement? <br />Mr. Brett said no; this is the TIF. <br />
