Regular Council Minutes 9-27-04 Page 10 Motion to Remove from Table; Motion to Amend and Second Readin of Ordinance l~lo. 2004-44, (formerly referenced as Ordinance 2003-43) entitled; "An emergency ordinance declaring improvements to certain parcels of Real Property to be a public purpose, describing the public improvements thereon to make service payments in lieu of taxes, authorizing an agreement with 6685 Beta Associates, establishing a municipal public improvement tax increment equivalent fund for the deposit of such service payments, and related authorizations pursuant to Ohio Revised Code Sections 5709.40, 5709.42 and 5709.43, and declaring an emergency." Introduced by Mayor Rinker and Council as a Whole. (First Reading 12/15/03.) Ms. Calta said it is referenced under 2003-43 but it has been renumbered as 2004-44. It will require a motion to remove it from the table; if you would like to pass, a motion to amend, a motion to suspend and a motion to pass. Mrs. Cinco, seconded by Mr. Saponaro, made a motion to remove Ordinance 2004-44 from the table. ROLL CALL: AYES: All NAYS: None Motion Carried Removed from Table Mrs. Mills, seconded by Mr. Saponaro, made a motion to suspend the rules of Council requiring an Ordinance to be read on three separate occasions. ROLL CALL: AYES: All NAYS: None Motion Carried Rules Suspended Mrs. Mills, seconded by Dr. Parker, made a motion to amend Ordinance 2004-44. ROLL CALL: AYES: All NAYS: None Motion Carried Ordinance Amended Council President Buckholtz asked for discussion on the amendment. Mr. Brett said the only amendments are the number and then I think just some housekeeping measures as far as the name of the entity from 6685 Beta Associates to Skoda, Minotti Properties LLC; the addition of Exhibit C which we had at the end of the ordinance before but did not declare and then just some minor points which I discussed with Bond Counsel; none of which make a substantive change in the implications of the ordinance-so mostly housekeeping, change of number, reference to an Exhibit C in the text. Council President Buckholtz asked, is this the Development Agreement? Mr. Brett said no; this is the TIF.
