Regular Council Minutes <br />9-27-04 <br />Page 29 <br /> <br />1 <br /> <br />First Reading of Ordinance No. 2004-40, entitled; "An emergency ordinance amending Codified <br />Ordinance Section 11.83.05 relating to the schedule of required off-street parking spaces." <br />Introduced by Mayor Rinker and Council as a Whole. <br />Ordinance 2004-40 was given first reading. <br />Mayor Rinker said I would like the record to reflect either at Caucus or the next Council <br />meeting just some discussion about these points because I think it behooves us to do that as <br />a group. <br />First Reading of Ordinance No. 2004-41, entitled; ."An emergency ordinance amending Section <br />337.28 of the Codified Ordinances of Mayfield Village regarding window tinting on motor <br />vehicles." Introduced by Mayor Rinker and Council as a Whole. <br />Dr. Parker, seconded by Mrs. Cinco, made a motion to suspend the rules of Council <br />requiring an Ordinance to be read on three separate occasions. <br />ROLL CALL: AYES: All <br />NAYS: None <br />Motion Carried <br />Rules Suspended <br />Dr. Parker, seconded by Mr. Marrie, made a motion to enact Ordinance No. 2004-41. <br />Council President Buckholtz asked if there was any discussion. <br />Chief Dearden said this was an ordinance that I asked the Law Department to prepare <br />because of changes that were made in the percentage of tint permitted on windows. After <br />talking with Mr. Diemert and Mr. Hanculak they chose to draft the legislation the way it is <br />prepared because the actual tint requirements are set by the Director of Public Safety and <br />can be changed at any time so rather than continually having to modify our ordinances, the <br />way it is drafted is anytime the Director of Public Safety changes the requirements, it <br />automatically is reflected by our ordinance. <br />Council President Buckholtz asked, any further questions? <br />Mayor Rinker said bottom line this is a safety issue. <br />There were no further comments. <br />ROLL CALL: AYES: All <br />NAYS: None <br />Motion Carried <br />Ordinance Enacted <br />
