Regular Council Minutes <br />10-18-04 <br />Page 11 <br /> <br />1 <br /> <br />Corned Beef Shop. The sign says it is closed for remodeling. There will be no expansion of the <br />Corned Beef Shop or any other kind of shop. I don't know if you want to act on the request---- <br />Council President Buckholtz said there is nothing to act on. <br />Mr. Diemert said with it being withdrawn, just let the record show that. <br />Mr. Marrelli said let the record show it was by phone. <br />First Reading of Ordinance No. 2004-45, entitled; "An emergency ordinance amending Section <br />333.01 of the Codified Ordinances of the Village of Mayfield by adding an additional <br />prohibition of operating a vehicle under the influence and refusing a chemical test having <br />previously been found guilty of OVI within the past twenty (20) years." Introduced by <br />Mayor Rinker and Council as a Whole. <br />Mrs. Mills asked, do we want to leave this on first reading? <br />Mr. Diemert said what we are doing here is just making it consistent with the State law that is <br />already in effect and we've always stayed consistent with State law. The provisions mainly are <br />changing the initials and having alook-back period of 20 years as opposed to, I think it was 6 <br />years before. They are provisions that have been debated statewide already and I don't think we <br />want to be inconsistent with the State law unless the Chief has any other feelings about it. <br />Chief Dearden no; we never run contrary to the State. <br />Mrs. Mills, seconded by Mrs. Cinco, made a motion to suspend the rules of Council requiring an <br />Ordinance to be read on three separate occasions. <br />Roll Call: AYES: All <br />NAYS: None <br />Motion Carried <br />Rules Suspended <br />Mrs. Mills, seconded by Mrs. Cinco, made a motion to enact Ordinance No. 2004- 45. <br />Council President Buckholtz asked if there was any discussion. <br />There were no comments. <br />Council President Buckholtz said in the eyes of our local law enforcement and our courts we <br />might as well be consistent with the State. <br />ROLL CALL: AYES: All <br />NAYS: None <br />Motion Carried <br />Ordinance Enacted <br />
