Regular Council Minutes
10-18-04
Page 13

Roll Call: AYES: All
NAYS: None
Motion Carried
Rules Suspended
1

Mr. Marrie, seconded by Mrs. Mills, made a motion to enact Ordinance No. 2004-47.
Council President Buckholtz asked if there was any discussion.
Mrs. Mills said in Finance, I made a suggestion that we add an addendum to the existing lease
hold that was prepared by Mr. Diemert to add that we would like to have a security deposit of
one month's rent in order to protect our interest in the building.
Mr. Chapman said Finance felt it would be a good idea to hold a security deposit equivalent to
one month's lease in the event that damages to the facility are caused by a member of the parish
or from their direct use. Obviously there are other groups that utilize such places [in the facility]
such as what has been referred to as Fellowship Hall besides the Clambake Group last week. We
have Rotary in and out of there on a routine basis; Alcoholics Anonymous uses the facility so
obviously it might be difficult on a Monday morning to determine specifically who may have
caused that damage. In all fairness we thought we would request a $1,200 security deposit more
or less on the honor system that if they know that damage has been caused by them and they
were to move out without correcting those damages that the $1,200 would be retained. It does
say within the context of the lease that in circumstance where they damage the property, they are
required to pay for the repairs and/or fix it. So it's not that we didn't think of it at all; we just
didn't think it was necessary to hold a security deposit in that regard. However, the change
recommended by Finance is being incorporated and we would hold that security deposit.
Otherwise Finance was satisfied with the document. I think our legal department has done a great
job in putting it together. It has been reviewed on this draft by the folks at Word of Grace; they
are very pleased and they find it consistent with their needs as well.
Mrs. Roman asked Mr. Diemert how the revision will be made in the document.
Mr. Diemert said we will interlineate it as a $1,200 deposit being necessary. If you want to
amend the ordinance you can but I don't see the necessity for it. Mr. Diemert addressed Mr.
Chapman and asked, do you think it would be a problem with them on this?
Mr. Chapman said I don't think it will be a problem at all.
Mr. Diemert said so we will just implement it if that is okay with Council.
Several members of Council said okay.
Council President Buckholtz said I have one question and certainly not any negative comment at
all, actually I am glad to see it here but do you know what kind of movie style screen or sound
system they are putting in? Do you have an idea of that? What size?
Mr. Chapman said they showed our Building Commissioner where they want to put the screen. It
will be on the wall at the far end of Sanctuary. It will cover that spot that doesn't look so good
