Regular Council Minutes <br />10/23/06 <br />Page 10 <br />Dr. Parker asked if that affects any of the sightlines on the street. Mr. Marrelli said it will <br />not have any effect from the street. His garage is about 300 feet back from the street. Dr. Parker <br />said that raising it is not going to make a difference. Mr. Marrelli said you will never see two <br />feet and 300 feet. Mr. Buclcholtz said that was the question he had, so just to clarify, it really will <br />make no difference on the impact of sightlines as far as raising the roof. Mr. Marrelli said it <br />would not. <br />Retracting that with the clarification that it goes back to the Zoning Board for height <br />variance, Mr. Marrelli stated that tonight's reversal would be on the square footage of the <br />building. Mr. Buckholtz said that we will just leave that alone. Mr. Marrelli said it will go back <br />just on the height and hopefully they will not have a problem with that. Mr. Buckholtz said that <br />it does not have to come back here if they approve. <br />Mr. Diemert asked that when Council approved this before years ago, was the height <br />discussed? Mr. Marrelli said that years ago Council overturned the Zoning Board in 2002. There <br />was no permit taken due to a health issue. Mr. Diemert asked if the height was changed then. <br />Mr. Marrelli said that it was lower then. It was at 15 feet, but Mr. Miozzi had not gone to the <br />Architectural Board at that point. Mr. Miozzi indicated that the architect came to the meeting <br />with suggestions. Mr. Miozzi does not have a problem going for one variance versus two. <br />Mr. Marrelli suggested that right now we work with the square footage that would <br />overturn what the Board of Zoning Appeals turned down if Council decides and then the next <br />step will be Architectural Board and then we will have to go back to the Zoning Board for the <br />height. <br />Mayor Rinker asked Mr. Marrelli if it was his understanding that had this gone in front of <br />ARB, they would have made that recommendation based upon the structural mass. Mr. Marrelli <br />indicated that was correct. The proportions are out of whack when we have a low roof on a wide <br />building. <br />Council President Buckholtz asked if there was other discussion ~at this point. Council <br />President Buckholtz clarified that we have a motion on the table, a "yes" vote is to overturn the <br />Board of Appeals' objection and to move forward with the project. Mr. Marrelli said that was <br />correct. Council President Buckholtz asked if there was any other discussion. There were no <br />comments. <br />Roll Call: AYES: All <br />NAYS: None <br />Motion Carried <br />Decision reversed. <br /> <br />1 <br />Mayor Rinker advised Mr. Miozzi that the neighbors will be notified again. Further, <br />Mayor Rinker suggested that ARB look at this entirely so that any adjustments that need to be <br />made can be recommended so that they can say, "this is how we think the finished product <br />should look." It will then go to BZA and in the interim, Mr. Miozzi should talk to his neighbors <br />
