Regular Council Minutes <br />11 /20/06 <br />Page 5 <br />Mr. Marrie stated that we do have wiggle room on how they are going to surround it. <br />Mayor Rinker agreed. Mr. Marrie added that that is a part he is more concerned about. We don't <br />have wiggle room on the other. <br />Dr. Parker asked if it is like the structure going in on Brigham Road toward County Line. <br />Mr. Marrie said that in the beginning it is going to look like that. Dr. Parker said that looks a lot <br />bigger than 3 foot tall. If you look at the one that just went in, it looks a lot taller than 3 feet tall. <br />Mr. Metzung said the standpipe is probably about 6 feet tall. The storage tank that is in the tank <br />farm that is now around the side of the building on the north side where they have the tank farm <br />with the tanks and separators, which are probably 8-10 feet tall is the area that needs to be <br />screened in. <br />Mayor Rinker indicated that at the end of the day the only input we have is on the <br />screening. Mr. Metzung stated that that was his impression in talking to this gentleman from the <br />state. <br />In lieu of that, Mrs. Mills indicated that in reading Planning and Zoning minutes, should <br />this be something that Planning and Zoning and Architectural Review should look at. Mr. <br />Marrelli stated Architectural Review for sure. He does not know if Planning Commission should <br />look at it. Mrs. Mills stated that we need to inform them that this is happening. <br />Mayor Rinker stated that we just got word of this last week. Ms. Calta added that from <br />what we know their permit has not yet been approved by the state. They just filed an application <br />with the state. <br />Dr. Parker asked if there are any issues with how close they can be to structures, <br />residence or anything else. Mr. Metzung said 100 feet. Mr. Marrie stated that there are a couple <br />in Gates Mills right in front of a house. They were not even 100 feet from a house. Dr. Parker <br />stated that it is constantly changing. It seems like they are trying to up the number of acres. <br />Mayor Rinker stated that federal policy is aggressive. Mr. Brett said that we are not <br />allowed to regulate where they go in, are we allowed to regulate abandonment when they go to <br />leave. Mrs. Mills replied that there is a state law for abandoning a well. Mayor Rinker added <br />that it is pretty comprehensive. Mrs. Mills said that the state is supposed to cap a well and they <br />don't. It takes them 5-6 years to look at your application. Not disputing it, Mayor Rinker said he <br />is aware of someone who had it done within a space of five months. Mr. Marrelli said that under <br />the Orphan Well Program, it is about 5 years. Mayor Rinker said there is a pretty established set <br />of requirements where they try to make sure that that does not happen in the first place. Mr. <br />Metzung said that the gentleman from the state told him that anything over a year of the well not <br />producing, they then declare it an abandoned site and it has to go. Mrs. Mills stated that her <br />experience in Euclid was that they had no idea where some of these abandoned wells were. She <br />happened to have one on her property. They just informed her after five years that they are ready <br />to now come in and cap that well. Mayor Rinker said that with the programs today, they monitor <br />everything. That is why we are involved to make sure that we are apprised. <br />
