Regular Council Meeting <br />12/18/06 <br />Page 5 <br />project. The Committee looked at it. Mr. Saponaro indicated that that person was key. The <br />approval and the right to work on the property was key to the project. They would not give that. <br />_ Mayor Rinker understood, but questioned if there is another alternative or another way we can <br />approach it. He is not suggesting we talk about it right now. A lot of people were bringing it up <br />and it seemed unfortunate that it came down to one individual if that many properties are going <br />to be affected. Mrs. Cinco indicated that they will look at that in January at the meeting. Mayor <br />Rinker stated that it is always a sensitive issue and he appreciates the fact that the neighbors did <br />not want to get into a proverbial match, but if it is something that is legit, we ought to figure out <br />a way that we can redesign it. Mr. Metzung stated that the rest of the group came back and said <br />that they did not want to pursue it, but if they are still interested, we are happy to go back and <br />look at it. Mayor Rinker said that it sounded like it left a bad taste in people's mouths. That is <br />one of those things that• can fester. Mr. Saponaro suggested that if they are still interested, we <br />should encourage them to fill out an application so that we can look at it in January. <br />Mr. Buckholtz stated that this is almost a duplicate of what happened on Beecher's Brook. What <br />happens is if people bring a project to us and we look at the area and say that this is a problem <br />that needs to be taken care of, one way or another it needs to be taken care of. On Beecher's <br />Brook, we ended up coming up with too invasive and too large of a cure for what they had in <br />mind. They just wanted the sides banked up a little bit and so forth. It's a structural thing on the <br />Committee, putting together what to do with projects when neighbors fall apart on it. Maybe we <br />need to get in there. <br />Mayor .Rinker said that we might want to see if we can mediate this issue. Mr. Buckholtz said <br />not so much between the neighbors necessarily, just so that the project, if it is truly a worthwhile <br />problem, like a water problem, we can work something out. Mr. Saponaro said that he does not <br />remember what it is. Someone will have to go back and take a second look. <br />Mrs. Cinco suggested that we verify in writing to the person that brought forth the project plus <br />the neighbors exactly what happened and why we did not proceed with the project so that there is <br />an understanding. Maybe there is just a misunderstanding. <br />Mayor Rinker asked that the Committee look at it. Then, the Committee and the Mayor or <br />perhaps Mr. Metzung and the Mayor can meet together. Mrs. Mills indicated that what Mr. <br />Erickson relayed was the fact that it was the terminology in the paper that Mr. Kenworthy was to <br />sign. He did not want to say easement because easement in his mind meant that when it was all <br />done and over with the Village was going to own his property and that is not right. Mrs. Mills <br />does not know how to get this across to Mr. Kenworthy. The Mayor was trying his very best, but <br />he was trying without Mr. Kenworthy being there. <br />Mr. Buckholtz stated that he is sure that the Committee can come up with some solutions. <br />Mr. Marrie relayed to Mrs. Cinco that he sent an a-mail to Diane when she sent `out a notice <br />about resurrecting the swale problem between Thornapple and Walnut which fell right in the <br />
