Regular Council Minutes <br />6-16-03 <br />Page 4 <br />SPECIAL COMMITTEE REPORTS: <br />S.O.M. Center Road Widening Working Committee -Mrs. Mills said she went to the pre- <br />construction meeting. Many people were there from the utility companies and businesses. On <br />July 7th, S.O.M. will be closed between Beta and Thornapple. They will also start construction <br />on the north end--starting at White Road. In the interim, they are working on the electrical lines <br />from Beta to Wilson Mills Road. <br />Wage Negotiations Committee - Dr. Parker said works continues but at this time there is <br />nothing new to report. <br />2020 Vision Committee -Mrs. Mills said the next meeting is June 25 here in the Community <br />Room. <br />QLD BUSINESS <br />OPEN PORTION -Regarding items under Old Business <br />There were no items under Old Business and no comments. <br />NEW BUSINESS <br />^ Yours Truly Liquor Permit <br />Council President Buckholtz said he would like to defer to the Law Director on this. <br />Mr. Diemert said as you may recall back in April when this first came up, we routinely get a <br />notification from the Department of Liquor Control whenever anyone applies for a permit or a <br />change in permit. I brought it to your attention, or your Clerk did, and because we didn't have <br />enough information, I just went ahead and asked for a hearing. Council didn't really vote on it, <br />we just said let's find out more information. The only way to do that was to request a hearing <br />which stalls the process. The process is now stalled but we have learned everything we need to <br />know and after investigating I have given you letters explaining that they already have a permit <br />but they don't use it for carry out. They don't plan on using it. They will never do carry out. <br />However, they do want to serve wine and beer at their tablesides as they do in most of their other <br />stores without incident. As a result, I explained all of this to Council that we really don't have a <br />basis for objecting. The hearing could still go forward. It would stall their process another 6 <br />months or so but at the hearing we need evidence. We have no evidence that this would not be a <br />proper location. Checking with the Police Department and Building Department in all the other <br />locations where they are, there just is not a misuse of this permit and there could not be an abuse <br />of it at this location, so unless Council feels otherwise, I will go ahead and withdraw our <br />objection so the process can go forward. They are not going to change the restaurant. There will <br />not be a bar, there will not be service from a bar, it will just be tableside. I don't know that <br />
