Council President Buckholtz said that definitely clarifies some of the issues that we had. Dr. Parker said at this point, what can they serve in their restaurant? Mr. Diemert said before this one-they have a beer carryout permit. Dr. Parker said with the new permit they can serve beer and wine or liquor but they can also sell it for carryout, correct? Mr. Diemert said no, they will be surrendering the carryout; they can't have both licenses. Dr. Parker said so all this would do is let them serve beer and wine at their tables. Mr. Diemert said correct. Dr. Parker said I just want to clarify that. Council President Buckholtz said I just want to add that this is basically what Aladdin's does in the other end of the shopping center. Let me just understand that procedurally if we do nothing, does that withdraw the objection or the need for a hearing? Mr. Diemert said yes; as your legal advisor I went ahead and signed this on your behalf. But after our investigation, I can't find a basis for the objection. If you still want to have a hearing, I serve at your command and you can tell me to go ahead and have the hearing anyway but I don't recommend it. Council President Buckholtz asked if there were any other comments or discussion. There were no comments.
