Regular Council Minutes <br />6-16-03 <br />Page 5 <br />Council needs to take action but if you choose to want to go forward on a hearing you'd need to <br />have an affirmative vote at this time to do that. <br />Council President Buckholtz said that definitely clarifies some of the issues that we had. <br />Dr. Parker said at this point, what can they serve in their restaurant? <br />Mr. Diemert said before this one-they have a beer carryout permit. <br />Dr. Parker said with the new permit they can serve beer and wine or liquor but they can also sell <br />it for carryout, correct? <br />Mr. Diemert said no, they will be surrendering the carryout; they can't have both licenses. <br />Dr. Parker said so all this would do is let them serve beer and wine at their tables. Mr. Diemert <br />said correct. Dr. Parker said I just want to clarify that. <br />Council President Buckholtz said I just want to add that this is basically what Aladdin's does in <br />the other end of the shopping center. Let me just understand that procedurally if we do nothing, <br />does that withdraw the objection or the need for a hearing? <br />Mr. Diemert said yes; as your legal advisor I went ahead and signed this on your behalf. But <br />after our investigation, I can't find a basis for the objection. If you still want to have a hearing, I <br />serve at your command and you can tell me to go ahead and have the hearing anyway but I don't <br />recommend it. <br />Council President Buckholtz asked if there were any other comments or discussion. <br />There were no comments. <br />Council President Buckholtz said then we will withdraw it. <br />^ A motion to authorize an expenditure in the amount of $10,000 to Betty <br />Montgomery (for audit of the Village's 2002 financial statement) <br />Mrs. Cinco, seconded by Mrs. Mills, made a motion to authorize an expenditure in the amount of <br />$10,000 to Betty Montgomery (for audit of the Village's 2002 financial statement). <br />Council President Buckholtz asked if there was any discussion. There were no comments. <br />Roll Call: AYES: All <br />NAYS: None Motion Carried <br />Expenditure Authorized <br />^ A motion to authorize an expenditure in the amount of $6,267 to Gates McDonald <br />MR-08-06 (2004 OML Workers' Compensation Group Program) <br />
