ROUGHDRAFT -NOT REVIEWED OR APPROVED BY COUNCdL <br />'' <br />'~ <br />10-20-03 <br />Regular Council Meeting <br />Page 7 <br />Council President Buckholtz asked if this includes the CD form. <br />Mrs. Roman said yes. <br />Roll Call: AYES: All <br />NAYS: None <br />Motion Carried <br />Expenditure Authorized <br />^ A motion concerning liquor permit at Shell Station. <br />Mr. Diemert said you asked us at the last meeting to check into it. Shell does not have at this time a <br />liquor carry out according to Liquor Board. They had the right to have a "C" license which is beer <br />carry out but they have never exercised it. They've just now applied for it even though they've had <br />the ability to have it. <br />Several people said they thought they had beer and wine in there now. <br />Dr. Parker asked if it would be just beer and wine or everything. <br />Mr. Diemert said for carry out beer. <br />Mrs. Mills asked, didn't they do that to us the last time. <br />Mr. Diemert said that was Yours Truly. They changed their status. They also had a permit in <br />safekeeping but they never served it [wine or beer.] It says they applied for it in 1988 but only <br />recently issued. <br />Mr. Marrie said I would have sworn that we discussed the beer and wine carry out for the Shell <br />station and we even went to the State on that and it was questioned and it was brought to our <br />attention that it was beer and wine and we approved it. The question I have now is he must have a <br />license now because he is selling it so he's got a license of some kind. So I think there's a mix up <br />here. Plus the note that we got said liquor. I don't know the numbers, Joe, but it did say specifically <br />liquor. That is the question Ihave-is he applying for a liquor permit? I thought a liquor permit <br />carry out would be only a state store or a state authorized store such as you might see in a TOPS <br />store. <br />Mayor Rinker said I think what Joe is saying is that the letter/number designation is a classification <br />and all that goes to the Liquor Control Department so the word liquor I'm suggesting is because of <br />the name of the department and not because of the type of permit but the motion should reflect then <br />the designated permit so there is no confusion. <br />Mr. Diemert said as a "C" permit, according to Liquor Control, that is just for beer/carry out. Like <br />we did with Yours Truly, if we object we could always withdraw it-or if we ask for a hearing. <br />
