Regular Council Meeting <br />11/21/05 <br />Page 3 <br />not interested. The resident who called, Mrs. Laurie Blood, indicated that she called someone else and <br />was advised that the gentleman had a permit. <br />Mayor Rinker indicated that the Chief will follow up on this. The standard operating procedures <br />should be reviewed. <br />Chief Dearden stated that pemuts are issued based upon the requirements set down by the Supreme <br />Court. Some organizations, if religious in nature, do not need a permit. However, regardless of <br />whether their permit is required or not, there are still stipulations in our ordinances which provide the <br />hours of time that they are allowed to go door to door. They are still not allowed to go to any <br />residences that have a No Soliciting sticker on the door. Chief Dearden will follow up with Laurie <br />Blood and see what we can do. We could always contact the organization and let them know that we <br />are not happy with the way in which some of the solicitors are conducting themselves. If we get <br />further complaints, we can pull their permit at any time. <br />Mr. Buckholtz stated that it was the same person. He asked if we provide the No Soliciting stickers. <br />Chief Dearden indicated that they were always maintained at City Hall. Dr. Parker asked if there is <br />anything in the pernut that stipulates that if someone says they are not interested, please leave, they <br />can't continue to follow up and have to leave. Chief Dearden indicated that pernuts are issued out of <br />the Mayor's office. He has not seen the form used. Dr. Parker said the homeowners have a right to <br />have the police follow up. Mayor Rinker indicated that they will. We have reports of two incidents of <br />comparable facts. The form was implemented to follow procedures. The ordinance conforms with <br />either state or federal regulations. Ms. Calta added that there was an Ohio Supreme Court decision <br />with regard to canvassers and peddlers. In 2002, our ordinance was amended to clarify that. If funds <br />are being solicited, you are required to get a permit. All residents were made aware that if they did not <br />want solicitors, they could put up a sign. Also, if you tell a solicitor to leave, it is the same thing as <br />putting your sign up. They should leave. <br />Mr. Buckholtz added that the gentleman was trying to get a donation of $40.00 for a booklet. Mr. <br />Buckholtz told him $40.00 is too much. The gentleman asked him how $20.00 was. <br />Mr. Buckholtz also stated that if you need identification to get in to such places as the airport, the <br />bank, and everything else, you should have identification for events such as this. We can't pass <br />something more restrictive than federal or state guidelines, however, we should look at the ordinance. <br />Mayor Rinker added that it is not a bad idea to review that. The Ordinance Review Committee may <br />want to revisit those issues. Now that we have specific facts, we can check on that. That is why we <br />encourage residents to advise us of occurrences such as this. This is a good opportunity for us to get <br />information. With two circumstances involving the same outfit, it is worthwhile, educational and a <br />way for us to be able to respond to it. <br /> <br />
