Regular Council Minutes <br />5/16/OS <br />Page 13 <br />Mr. Marrie said we have no say in it whatsoever, zero. <br />Mr. Marrelli said we do have a provision in our zoning code under Special Use Permits that <br />auto and gas wells are actually a Special Use Permit in our code. So sometime ago that was <br />asserted into our local code. <br />Mrs. Mills said that is because we had gas wells here. <br />Mr. Marrelli said and I think you still can but the procedure is that the person would have <br />to go to the Planning Commission and then to Council and get a Special Use Permit for <br />that. <br />Mr. Brett said I think this legislation bypasses it. <br />Mr. Marrelli said I believe it does too. The only reason I bring this up is if you go public <br />against it, it is sitting in our code so it is showing both sides. It is like well you allow it but <br />now you are coming out against it publicly--- <br />Council President Buckholtz said no. we aren't coming out against drilling of gas wells. <br />What we are coming out on is the jurisdiction of the state overriding our own. In fact, we <br />are supporting it-the Resolution that we would want to do-if not a full ordinance -but <br />we could leave that for the Caucus. The easiest thing to do right now because it is a timely <br />issue and we should get it out there now. I would like to recommend if somebody would <br />like to move that we create a Resolution in title to support this ongoing issue-with just <br />what we understand here today and not go any further than that. If we want to join the fight <br />officially through an ordinance, we will discuss that at Caucus. <br />Mr. Marrelli said this issue is of control. <br />Council President Buckholtz said right. The issue is that we can enforce our ordinance. <br />Right now we can't. Would anybody like to make that- <br />Mrs. Cinco asked, did you want to make that tonight or did you want to at least see a <br />Resolution in print- <br />Council President Buckholtz said then let's set the whole thing up and discuss it at Caucus. <br />Mr. Diemert said I will get a draft of what they are adopting. <br />Council President Buckholtz said that is fine; very good. <br />First Readim of Ordinance No. 2005-18, entitled, "An emergency ordinance authorizing and <br />directing the Mayor to enter into a Development Agreement with Progressive Casualty Insurance <br />Company relative to the southern most part of the Northwest Quadrant."
