DRAFT <br />Council6/20/OS <br />Page 17 <br />Mr. Catiechio stated that we felt every five years was a little too frequent; they felt every ten <br />years would be more than enough. <br />Mr. Marrotte stated we did due diligence on that, besides feeling it, we did talk to people in other <br />communities about it and saw it was a much longer period, so that was the reason for the <br />recommendation. When the Commission did this, two of the people were on it five years ago, <br />the rest of us are new, they did a lot of the clean up then, with the exception of the one that we <br />have debated at length here. We don't think that this has to be done every five years. <br />Dr. Parker stated he felt the Commission had done an excellent job. Dr. Parker stated he has two <br />concerns; the first one is you may not need to change anything, but it would be a good idea to <br />have a group of individuals look over it every five years and have the familiarity with it. <br />Mr. Marrotte stated that some of the people were on the Committee before, and you develop a <br />continuity over a time frame that's realistic and not going to lead to large time span between <br />groups that have reviewed this. He is a little concerned about the number, 10 years. If you want <br />to say 10 years or as deemed necessary by Council, maybe that is some kind of a way to bridge <br />the gap between five to ten years. He believes there is something to be said, even if nothing is <br />done, to have it reviewed every five years. If you wait for ten years, it can lead to problems. <br />Mr. Catiechio asked when was the last time the United States Constitution was reviewed? What <br />kind of due process do they have for that. This is our Constitution here, our Charter is our <br />Constitution. <br />Dr. Parker said there are substantive changes and what would have happened if we would have <br />waited ten years instead of five, that you are proposing now. Dr. Parker asked Mr. Caticchio, <br />would you say these changes are not necessary? <br />Mr. Catiechio stated the changes came about because something is wrong, you end up in Court, <br />you end up in litigation. <br />Dr. Parker reiterated, had you not met at this point, these changes wouldn't have occurred. Dr. <br />Parker stated, just food for thought, he doesn't know if he's comfortable for ten years. <br />Mr. Marquardt thinks ten years is good and Mrs. Cinco agreed. Mr. Marquardt thinks ten years <br />is reasonable, if you review more often, you always make changes and you wind up making it <br />more tangles than it ought to be. <br />Mr. Buckholtz asked if we provide a way to change the Charter at any time and Mayor Rinker <br />said yes, by Council. Mr. Buckholtz stated he agreed with Dr. Parker's concern, can you just <br />meet and not make any changes at all and say, it is just fine the way it is.
