Regular Minutes
5-20-02
Page 6
Mr. Diemert said the second page of the ordinance should have a little 3 at the bottom; the only
change is under the b and c--the last line of each where it says material and similar items would
be amended to read material and oY similar items. That came from the Judge and the final
recommendation of what she'd like to see.
Mr. Marquardt, seconded by Mr. Ilacqua, made a motion to amend Ordinance 2002-07 as Mr.
Diemert stated.
Roll Call: AYES: All
NAYS: None
Motion Carried
Ordinance Amended
Mr. Marquardt, seconded by Mrs. Mills, made a motion to enact Ordinance No. 2002-07 as
amended.
Council President Buckholtz said, for the record, Vince Feudo was kind enough to run this by
Judge Bozza who approved the last one and that was one comment she had. The only other one
was a concern from an earlier ordinance about when this ordinance was first enacted in 1962,
people were given 12 months to comply because it was brand new and there was an issue
involving screening the vehicle during that time. I just wondered, for her benefit out of
courteousness, that we don't have to amend this, we don't want to change this, it stands as
written, but Bernie--more or less directed to you, we want to make sure people understand they
have the opportunity to either build a structure and move the vehicle and they would all be given
time to do so. If we could negotiate if it is properly screened and they can move the vehicle, then
we will have it all taken care of in a reasonable amount of time.
Mr. Samac said "understood."
OPEN PORTION - 3-minute limit imposed by Chair. Those who wish to speak must first
state their name and address. This open portion is limited to discussion pertaining to the items
under "Old Business" only.
Rick Christian asked what was meant by commercial vehicle.
Council President Buckholtz said we have been working on this for months.
Mr. Diemert said it is defined in the ordinance.
Council President Buckholtz said it is described as "any vehicle used for cominercial purposes
that also has signage or equipment attached to it." It doesn't matter whether it is a passenger
vehicle, a small minivan, a small pickup; if it has signage and or it has equipment hanging off of
it and it is used for commercial purposes, it is not allowed in the driveway.

?
